City Commission candidate calls for outside review of controversial Dayton PD traffic stop

https://www.whio.com/news/local/city-commission-candidate-calls-outside-investigation-into-controversial-dayton-pd-traffic-stop/AE2LSHPPEVASPICIATO62VHP5Y/

Owensby previously told News Center 7 that he cannot walk and was out running errands without his wheelchair. Dayton City Commissioner Darryl Fairchild uses a wheelchair and said it was not unusual for someone to leave their wheelchair at home while running a quick errand.

Body camera footage showed officers telling Owensby they were going to assist him getting out the car.

“No you’re not. No you’re not. You don’t touch me. You’re definitely not about to touch me,” Owensby said.

A standoff continued until officers physically took hold of Owensby and dragged him out of the car.

A traffic stop gets a ticket, not this.

He had tinted windows! This looks like DWB and and illegal search of his car.

America is becoming more racist and dangerous.

Maybe if he'd said "paralyzed," he might have had more luck. But I doubt it.

I'd give the steroid-addled cops a choice: face termination and indictments for aggrieved assault and battery, or...

repeat the third grade, with a requirement that they display their diplomas prominently pasted on the side of any vehicle they operate while on duty--something they may not resume until completion of the third grade repetition, with filmed certification of having completed the year from the elementary school that graduated them.

*Grammatical note: the singular of the word "paraplegic" is the same in both Republicanese and English. No excuses there.
Only the plural is different. In English, it's "paraplegics." In Republicanese, it's "paraplegic's."

The town realizes their cop is illiterate, and forces him to attend 4th grade.

All leads up to this bit at the end:

It should have dawned on me that asking American cops to understand standard four syllable words in English was a theme that had been examined before.............

And you could tell by the tone in the officers' voices that they were long past being professional.

I'm betting the window tint was a pretext after they ran his plate and saw the priors, since those would provide reasonable suspicion for a search.

The weapons charge is likely also why they wanted him out of the car. And under Pennsylvania v. Mimms, officers ordering someone out of the car for a pat-down to check for weapons isn't a violation of the Fourth Amendment.

They could've just had one officer sit in his cruiser behind the car while the others went back into service while a sergeant was en route. Sounds like all dude wanted was to talk to a supervisor, who might have been able to get him to comply.
