Texas says cannabis extract 'delta-8' is illegal, sending retailers scrambling

Three years after federal legislation removed the marijuana extract known as delta-8 THC from the nation's list of controlled substances, Texas health officials have put it on its own list of illegal drugs, sending a shockwave through the growing CBD retail industry across the state and making the substance, essentially, illegal.

Christine Perez, who manages the popular Austin CBD store Lazydaze+Coffeeshop, had no idea about the change until she saw the Texas Department of State Health Services notice on the agency’s website on Oct. 15.

“I was very confused, as well as a bunch of other companies. It’s like, ‘What is going on?’” Perez said. “I really have no idea why [the state] would try to ban it, or the timing of it. We didn’t hear anything about it from the state.”

As The Dallas Morning News reported this week, the state health agency placed a notice in the rule change publication, the Texas Register. The notice said delta-8 remained a controlled drug in Texas. Both the federal government and states can differ on what is a controlled substance by keeping separate lists. Still, word failed to get out to CBD stores that anything containing the substance, like candy or tincture oil, would be illegal to sell in Texas.

It became the top product for many dispensaries in Texas, as users say it produced the “high” effect of marijuana. The variant became popular after the 2018 Farm Bill changed the definition of “lawful marijuana extracts” and included any extract that has lower than 0.3% tetrahydrocannabinol (THC), including delta-8. THC is the active psychoactive ingredient in marijuana, responsible for the user’s high.

I've grown weed for years but the stuff they are getting from dispensaries makes me catatonic. Its very strong in most cases. (I mean the flower not the delta 8 stuff never had that btw)

Seriously though it's like a 50 or 60% of Delta 9 which is the typical cannabis. In addition it just doesn't get you really very high I'm sure you could if you take enough kind of like one beer is fine and 12 beers is not but it is amazing relaxation.

Maintain as in I can function and actually read with Delta 8 where with Delta 9 not so much.


It's just super calm. I hope when all cannabis becomes legal they don't stop making Delta 8 because Delta 9 gets everybody higher.

Other THC products do make me high. I wonder why Delta 8 doesn't do much for me. I even upped the dose by a lot . . . nothing.

I get the edibles gummies from a place in Colorado called Denex.

They're tested and certified. I did get early on het some of the bud but all that is is hemp leaf doused in Delta 8 oil. I tried some of that and it barely did anything. The gummies on the other hand work.

I prefer to roll a joint but not with the fake leaf. So gummies will do.

But if you got the gummies where did you get it maybe they just weren't very honest?

They are my favorite way to fly these days. Much more predictable and easy to control than shit with canabutter... eat too much of that and you are stoned the next morning!

If it wasn't for them mucking everything up Texas would be a much better place. But they cause progressives and liberals to hate everything Texan, including the inhabitants which means me.

In my opinion in the THC that works. The small amount of THC that CBD contains is what works.

it is not placebo but the amount of CBD it takes to get effective results is very high. This was proven during the testing of the CBD treatment for epilepsy. I was using CBD exclusively before delta 8 was available and I had to buy the most potent tincture from a reputable dealer. It was very expensive. I think most of the OTC, low dose supplements are placebo.

It's true that CBD + THC is best. Once delta8 became available I got some and it was perfect for my symptoms with minimal impairment. Plus it was about 75% less than what I was spending on the CBD alone, for the edibles and about 90% less for flower. Flower seems to be less consistent than edibles.

Of course, I expect TN to do something very similar very soon. Bummer.
