(46,757 posts)Ex-presidents DO NOT have executive privilege. And why should we wait to find out? The Committee should use its own understanding of the law.

(8,387 posts)Do ex-Catholics maintain privilege in their confessions to a priest?
Do ex-clients of a lawyer maintain privilege in their communications with counsel?
We might want to wait to find out because simply declaring a legal proposition doesn't make it so.

(5,325 posts)And they're getting away with it. If they can bog down the process well into next year, it becomes a campaign issue to energize their base for the midterms.

(36,509 posts)And we can't afford to lose one chamber. Traditionally, dems don't turn out well for midterms. 2018 was an exception.

(21,400 posts)The Appeals court will rule on Nov. 30th and I expect a favorable ruling, turn over the documents. So without a doubt Trump appeals to the Supreme Court. What happens to the "stay." The DC court rules turn over the documents but Trump appeals to the SC, does the SC issue a stay until the gods know when they will issue a decision? Does the SC meet over Christmas?
Let's also not forget an important fact, Steve Bannon was low hanging fruit, not a part of Trump's administration. So will former members of Trump's administration who are subpoenaed have a different argument than Bannon? Will we have to go through this mess again with former Trump administration people? If so, may as well watch Steve Kornacki and pray.
Unless the House decides to use its own inherent contempt authority, nothing at all will happen.

(17,455 posts)Instead of looking for ways to weasel out of testifying, how about instead, these assholes willingly appear in front of Congress and answer their questions?
You know, like Secretary Clinton did for 11 hours.
