3. He isn't in the Senate and what he's doing isn't a filibuster; the House doesn't use them.

He's just blathering for as long as he can in an attempt to force the House to vote on the bill in the middle of the night. Pelosi outsmarted him again, though, and has scheduled the vote for tomorrow, during the day.
