the prosecution basing their entire provocation claim on a blurry mess of a video. The facts of the case were weak. Their own witnesses helped the defense more then the state, and their own actions/behavior didn't help either.

With the wording of the laws of WI, in this situation the prosecution essentially was down six runs in the bottom of the first.

They went with his risk approaches, hoping for a lucky break or misstep my someone to get around the unfavorable position dictated by the laws at hand and the evidence.

They didn't get it, and that was all they had left.
