So does justice Robberts really believe laws passed 50 years ago or more are now defunct?

What a fucking dickhead. No wonder this Supreme Court is such a mess. We have complete idiots in charge of constitutional law.

Lack of encorement. If a law were on the books for a long period of time and prosecutors fail to enforce it, then, suddenly seek to do so, the case would fail for selective prosecution. However, this is not the case here.

This law clearly has been actively used by the executive branch since its inception. Robert's is making a ridiculous arguement. I will add, he is known for pushing the points he anticipates from his belligerents to the right (Thomas/Alito). So, I would not jump to conclusions about his position.

Also, there is an article on CNN, I am going to read later that says he seemed to be in favor of Biden.

This would be a reasonable argument to change the Second Amendment. It's way older than 50 years old.

The sad part of it is that it might actually be worse if it was written today.
