(104 posts)Lack of encorement. If a law were on the books for a long period of time and prosecutors fail to enforce it, then, suddenly seek to do so, the case would fail for selective prosecution. However, this is not the case here.
This law clearly has been actively used by the executive branch since its inception. Robert's is making a ridiculous arguement. I will add, he is known for pushing the points he anticipates from his belligerents to the right (Thomas/Alito). So, I would not jump to conclusions about his position.
Also, there is an article on CNN, I am going to read later that says he seemed to be in favor of Biden.

The sad part of it is that it might actually be worse if it was written today.

Whether you agree or disagree with that comment he did not say laws expire after 50 years or anything close to it.
