Former Secretary of State Hillary Clinton on Thursday criticized Fox News' coverage of her connection to what some conservatives have argued was a plot to spy on former President Donald Trump but that fact-checkers have found to be severely lacking in context.
Clinton went so far as to accuse Fox of brushing up on the line of actual malice, an important legal distinction in defamation law.
"It's funny the more trouble Trump gets into the wilder the charges and conspiracy theories about me seem to get," Clinton said during a keynote speech at the New York Democratic Party's convention. "Fox leads the charge with accusations against me, counting on their audience to fall for it again. As an aside, they're getting awfully close to actual malice in their attacks."

The track record of denigration, unsubstantiated claims, minimal retractions and incitement of others are cumulative in nature and show a pattern of harm not only to reputation but of physical being.

It really says it clearly, though, how Fawks backed down after her threat to them. It also shows how phony they are since they suddenly changed their script. It'll be interesting to see what the future holds on both sides. I really do hope she sues them. They've been after the Clintons since day one. There's more than enough evidence to slap them down silly.

This is so uncharacteristic of Hillary. I wonder if it portends something more widespread by her or by Dems in general. Maybe just to force Fox to tread a bit more cautiously. Can they afford more lawsuits - after Dominion?

The Supreme Court, in New York Times Co. v. Sullivan, 376 U.S. 254 (1964), established the "actual malice" standard in defamation actions brought by public figures. A public figure must prove that the person uttering the defamatory statement did so "with knowledge of its falsity" or with "reckless disregard for the truth of the statement". It is a high bar for a defamation plaintiff.

Hillary is telling Fox to watch its step.

We ordered an electric recliner for my husband that was delivered with a sickening odor. We shut it up in the 2nd bedroom with towels stuffed in the door and tried to open windows as much as possible to let it "off gas"

After 3 weeks of it I finally managed to get a sales manager that told me to take it outside. It's winter, in Lexington. I live on the 2nd floor with no balcony. My husband is on chemo. I can't lug this downstairs alone and can't park it out in the parking lot. It was a completely ignorant request.

I told the guy. The bottom line is this thing is making us sick. Was he going to help get it out of the house and make us whole or would I have to seek remediation some other way.

Less than an hour later, he personally came to the apartment with his nephew and a refund check to take the chair back.

Whip out a legal term and everyone hops to.

Is Hillary Clinton a "public figure" when she holds no public office, is not seeking office, and has otherwise been leading a private life? Equal protection under law might have greater bearing than past elective and appointed office.

Actual malice in United States law is a legal requirement imposed upon public officials or public figures when they file suit for libel.
