Rudy Giuliani has canceled an interview with the committee investigating the Jan. 6, 2021, attack on the Capitol that was scheduled for Friday after the panel rejected his demand that he be able to record it.
Mr. Giuliani had agreed to participate in a transcribed interview with the Select Committee, said committee spokesperson Tim Mulvey in a statement obtained by The Hill. Today, he informed committee investigators that he wouldnt show up unless he was permitted to record the interview, which was never an agreed-upon condition.
Mr. Giuliani is an important witness to the conspiracy to overthrow the government and he remains under subpoena, Mulvey continued. If he refuses to comply the committee will consider all enforcement options.
Giulianis personal attorney Robert Costello confirmed to The Hill that they had canceled the interview, which would have been held virtually, after the request to record was denied. Costello confirmed that the two sides were still in talks.

(82,849 posts)But seeing as it was a last-minute demand by Giuliani or his representatives, I would theorize that the committee was concerned that Giuliani, as the recorder, would doctor the recording in ways to give an inaccurate account of what actually happened. I don't know why anyone would be so suspicious of Rudy Giuliani, though.

(9,481 posts)The smart ones might be able to figure out what the Committee has based on the questioning and where they can get away lying, or maybe the "loose ends" that need dealing with.

(82,849 posts)Depending on the witness, and like it or not (I don't) Rudy Giuliani is in The Club and entitled to be a big shot. Which means he get to negotiate all kinds of pre-conditions and ground rules and other foofaraw that lowly peons like me and you would never get to demand for an appearance before the committee. The committee could accede to Giuliani's late demand to record the proceedings. But they wouldn't be "free" to record it themselves. That would be an entirely separate negotiation with Giuliani's legal team.
I suppose the Committee could say, "Sure you can record it if we can, too," but I suspect the Committee has a reason for not allowing any party to record the proceedings. If they got a mutual agreement with Giuliani, would they be subject to other witnesses demanding to record their appearances? Would they have to go back to the witnesses who have already appeared and give them another chance to testify, this time with a recording? Once the Committee has begun receiving testimony under one set of rules, changing the rules or accommodating an exception opens it up to have to start all over again with the first witness. Some of us think things have been moving slowly enough without recalling witnesses to testify again.
