Alito's SC draft opinion?
She's ideologically driven and will stop at little to get her way as we keep learning.
I think she wanted the draft to be public so that judges would feel "locked into" their positions.
In fact I would be surprised if the leaker was someone else (not including Clarence who she likely persuaded to do so).
If the investigators at the SC or FBI found out it was Ginni, will we ever know?
I'm guessing they already know.

(46,758 posts)Clarence Thomas was very taken back about the leak, and I suspect it was a red herring. Not sure why he would bother since these things tend to come out.

(3,879 posts)If she's willing to overthow democracy in favor of autocracy, then she'd turn the brief over in a heartbeat. She's the only real suspect. What will be done about it? Nothing, of course.

If it's not known, it was probably because investigators got to a point in their investigation where the answer became obvious and they shut down their work, hoping the question would go away.
Or maybe they are still trying to figure out how to release their findings.
(If Thomas retires from the bench "to spend more time with his family," we'll know for sure.)

(2,343 posts)They know who did it or were close to figuring it out and pulled out. There's more interest in protecting all the justices--irrespective of judicial philosophy--than embarrassing the one who did it or who had a staff member who did it.

Logic: Clarence, realizing the finding will end his career on the SC, has asked investigators/John Roberts not to announce their findings until he can retire without being replaced with a Biden nominee since he knows McConnell will not bring a Biden nominee to the Senate floor if Republicans take the Senate.
Our job, then, is to keep the Senate by getting out the vote.
And we should also keep publicly questioning who the leaker was. It seems as though the story is dying. Keep the heat on.

(2,343 posts)With so much going on in the world, it's easy for this kind of story to go away.
I really want the leaker caught. I do believe a conservative did it with hopes of keeping everyone tacked down to the 5-4 result. But, whoever did it--correct side or wrong side--they need to be held to account. If this were to become a common thing, it could cut both ways in the long run.
And the thing that bugs me the most is that one person (or I suppose more than one) decided they knew what was best and released the draft. This may end up having the exact opposite result than what they hoped for.

(So they agreed to wait to release findings until next Feb.)

(2,343 posts)But, it it were an illegal act (and from what I read, most think it was), then sure, the leaker should suffer the consequences. This kind of act cannot be allowed to be commonplace.

(2,343 posts)One can hope the final opinion is significantly different. I dont expect it, but I can hope.
Nonetheless, the leaker was wrong to believe they knew it was the better idea to release it.
For one to say it was OK to release the draft because it was a bad opinion is like saying a murder was OK because the victim cheated on his wife, kicked a puppy or voted for Trump.
