We're Suing WMAL For Rejecting Ad for The Last War Crime (The Pen <theteam@peaceteam.net>)

Dear Friends and Activists:

We are fighting back.

As you already know, we have encountered many obstacles in getting
the word out about the new feature length narrative film, "The Last
War Crime," which poses the bottom line question, "Will anyone ever
be held accountable for torture and the lies that took us to war?"

First YouTube banned our waterboarding clip (We beat them back on
that). Then MTV (Viacom) rejected our video ad for their Times Square
jumbotron. Then WMAL, a big right wing news/talk radio station in our
nation's capitol, rejected the ad we sent them. So we are filing a
law suit in federal court in Washington, DC, on a cause of action for
political speech discrimination.

The legal papers are in transit and will be filed just as soon as
Hurricane Sandy blows over (US government offices being shutting down
Monday, October 29th). Our primary argument against WMAL, controlled
by Cumulus Media Inc., the second largest conglomeration of right
wing radio stations in the country, is simple. Federal law already
requires radio stations who take ads from one political candidate to
accept ads for all. We contend it is an equal protection violation of
the 14th Amendment for this law not to apply also to ads related to
public policy. And we believe there is a case to be made also on the
First Amendment.

We are especially interested in hearing from you if you would like to

It is simply outrageous that giant special interest corporations can
now spend unlimited war chests to put their fat thumbs on the scale
of our political process, because of the Citizen's United decision.
How much more outrageous is it that these SAME corporations can
reject out of hand ads they do not agree with politically.

All we have to fight back with are your voices. Please use yours now
while we still have a chance.

I doubt it, but they might. But I don't think they have any case on a First Amendment basis. The First Amendment doesn't apply to businesses, and the radio station is a business.
