First, there is no place where it is currently illegal and no place where it is likely that the state legislature will attempt to pass a law banning it. Second, it would be struck down because the Loving case was based on the equal protection clause, not the due process clause.
But folks are going to continue to flap their gums about it instead of focusing on things that are much more likely to be of imminent concern.
