The court also agreed to hear arguments on the merits of the case next term in its December sitting, adding another substantial dispute to the court's docket that already includes cases on voting rights, religious liberty, the environment and affirmative action.
This is quite a stunning division on the court, really, to me at least, and maybe an indicator of Justice Jackson's power of persuasion?
I don't expect her vote on social/moral issues but if Barrett/Sotomayor/Kagan/Jackson bond and form a 4-justice bloc on some issues, they may be able to bring Roberts along and moderate the court some on issues like the independent state legislature theory. This gives me hope that we could have Roberts and Coney Barrett joining to say that a state legislature cannot just appoint the president. Maybe Barrett has certain lines she won't cross? Horrible on most things, but not everything?
Until we can expand the court or appoint a replacement, at least there's a small beacon of hope that they may not be entirely out of control. I'm willing to settle for at least a hint of reasonableness occasionally from these lunatics at this point sad as it may be (until we have 52 senate seats, a house majority and can expand the court or at least overrule it).

(7,873 posts)I cannot, for the life of me, understand why some of those on the left are willing to bend over backwards to give Republicans the benefit of the doubt, especially when -- not saying you, just certain folks on the left -- are so willing to criticize our good Democratic leaders over the most trivial of matters and cast a wary eye on them and their motivations.
I just don't get it.

(1,835 posts)Just allow me some hope that she won't declare that state legislatures elect the president, not the voters. This case, today, gives me at least some hope that she may be persuadable in that regard, emphasis on the word may. Just grasping at straws as that really is a huge case that we need to win. Hopefully, it will be moot with the upcoming ECA reform bill and success in the November elections, but, if not, at least there's a slight ray of hope.
Also, if these 4 start voting together as a bloc more and more, that would be HIGHLY significant.

Know how McConnell lets Collins vote for certain things when it doesn't matter, yet when he actually needs her vote, she always goes against what we, as Democrats, would want?
Yeah. I'd say Coney Barrett's useless dissent in this case is much more akin to the Collins situation than her having any shred of decency. When she overturned Roe v. Wade, she told everyone all they needed to know about her.
The hope you should have is that her evilness has been on display for the whole word to see and that will hopefully motivate those on the left to turn out and vote Democrats into office so we can actually do something to combat her and her conservative fascist friends rather than simply hoping they aren't as bad as they've already shown themselves to be.

(1,835 posts)My first preference is 52+ senate seats and a retained house majority (although I am not convinced that there are 50 Democratic votes to expand the supreme court or limit its jurisdiction right now. Codify Roe and Obergfell? Yes but lots of other damaging cases that need to be addressed too besides those. We can't just codify those two and then let the court be off on it's merry way) So if that doesn't happen, it's nice to have a little hope that perhaps the independent state legislature theory isn't a slam dunk and to not be in a perpetual state of doom and despair as I have been the last couple months.

(9,967 posts)... we may see several of them be the "fourth vote" when it doesn't count. They can say the court is "fair and balanced" while the majority continues on its merry way.
