'The Court has no comment': It's not publicly known whether the May leak of Alito's draft opinion on

Roe v. Wade is still under investigation

WASHINGTON (AP) — Less than 24 hours after the unprecedented leak of the draft opinion that ultimately overturned Roe v. Wade, Chief Justice John Roberts ordered an investigation into the “egregious breach.”

Since then? Silence.

The Supreme Court won’t say whether it’s still investigating. The court also won’t say whether the leaker has been identified or whether anyone has been disciplined. Or whether an outside law firm or the FBI has been called in. Or whether the court will ever offer an accounting of what transpired. Or whether it has taken steps to try to prevent a repeat.

To these and other emailed questions, Supreme Court spokeswoman Patricia McCabe said, also by email: “The Court has no comment.”

under the bus. The “Move along, nothing to see here,” response means it was a conservative. I’ve said since the investigation was announced that we’d never hear who did it if it was a conservative who leaked.

I've seen a couple of analyses on other web sites making the case for Alito as the leaker. The theory being that by leaking the draft opinion, he pinned down Justice Boof, who may have been wavering on whether to make women second class citizens all at once or to continue the chipping away of their humanity that conservatives have been practicing for years.

Chief Justice Roberts, who was initially so grrrr mad! about the leak seems to have cooled considerably in his ardor to find out whodunit.

There's no federal law which would prohibit someone who legally has access to the draft opinion from leaking it.

An investigation and finding out "who did it" is about finding out whether someone illegally obtained a copy of the draft. If that's not what happened, that satisfies an investigation.

There's also no internal mechanism, zero, for a Chief Justice to punish a justice who leaks. Hell, the individual justices hire their own clerks so if a clerk took it upon himself to leak the draft, I doubt the Chief Justice could do anything other than request the justice fire him.

I understand he has been working on his "legal" justification for overturning Roe since his college days.

I bet he has revised this over and over and thinks it is brilliant. And he wants the world to see his brilliance in all its glory.

Benefitted the right, ergo leaked by the right. Some say Alito himself. Don’t know why Ginny would have a copy, but if she did, many here think she did it.

If it was then Roberts probably feels he has to bury the story. The courts legitimacy is toast and he has been trying to prevent that for as long as he has been chief. Given the publics opinion of the court and that decision, admitting that someone like Ginni leaked the draft out of smug satisfaction would be a disaster. I am not saying I agree with the decision nor do I believe it's right. It does seem plausible though.
