ACLU sues Indy over newspaper for homeless

INDIANAPOLIS — A federal lawsuit claims Indianapolis officials are violating the First Amendment by preventing homeless vendors from selling a newspaper downtown in the week leading up to the Super Bowl.

The Indianapolis Star reports (http://indy.st/xzYuxp ) the American Civil Liberties Union of Indiana filed the lawsuit this week on behalf of Jeff Tavares, volunteer editor and publisher of Homeward Bound.

Tavares says he was denied a temporary city permit that would allow newspaper sales in the Super Bowl "clean zone" surrounding Lucas Oil Stadium. He says that violates the First Amendment, which guarantees freedom of speech and freedom of the press.

A city spokeswoman says no permit is needed to sell newspapers.

The ACLU says it will withdraw the suit when it receives formal notification the newspaper can be sold.

These type of nanny state government regulations that bar homeless people from polishing people's shoes, selling newspapers or performing on the street for a small donation. And don't get me started about the clumsy government bureaucrats with B.O. who
stop boys and girls from the horror of selling lemonade on their neighborhood block.


Too many bureaucrats and too many laws on the books to enforce.
