Walmart is ordered to pay $4.4million in damages to black man shopping for a light bulb after store employee profiled and harassed him then called cops when he refused to leave
Mangum, who was 59 at the time, visited the Walmart in Wood Village on March 26, 2020, to buy a light bulb for his refrigerator.
The litigation was a landmark test of a recently passed state law allowing lawsuits against anyone who improperly calls law enforcement with the intent to discriminate, his lawyers said.
After Mangum arrived, he noticed store employee Joe Williams watching him as he shopped.
Williams told Mangum to leave the store, but Mangum refused, saying he'd done nothing wrong.
Mangum's lawyers said Williams told Mangum he was going to call the police and tell them Mangum had threatened to 'smash him in the face.'
Williams called the non-emergency police dispatch line and told the operator he 'had a person refusing to leave,' the lawsuit states.
But according to Mangum's lawyers, deputies from the Multnomah County Sheriff's Office responded and 'refused to take action against Mangum.'
The lawyers said deputies made that decision based on Williams' 'shifting explanations' for the reason he called and because of his 'reputation for making false reports to police.'
According to Mangum's lawyers, the next day, Sheriff's Sergeant Bryan White and another deputy met with the director of the Walmart and the assistant manager and explained that deputies had noticed a 'pattern of behavior' in which Williams would call police to report 'dangerous active situations, such as customers physically assaulting him or other employees,' that were not happening.

(32,729 posts)called me up front. 4 young Black men had come in and she wanted me to watch them. I said sure and walked up to them and greeted them and asked what they collected and they told me. I showed them around and found out they were in town from Detroit and we became friends very quickly. Traded stories about Detroit and helped them find a few things that they bought.
As they were leaving they thanked me, by name, and were all smiles.
Manager, she gave me a very dirty look.
After thinking about it for a day, I quit.

(17,865 posts)Why didn't they Jussie Smollett the moron the first time he made a false report. The cops were proactive just not proactive enough.
Needless the say Wal-Mart has a real problem in their hiring decisions at this location. How the manager allowed him to keep his job after this is beyond me.

Ive always been impressed with the compassion and integrity of the Multnomah county sheriffs office. Ive had to call them a few times about a neighbor - former neighbor really- who has dementia and keeps showing up at their old house. The sheriff deputy was always quite clear that theyre trying every option to get the neighbor connected to the right resource and not arrest them for trespassing.

(6,254 posts)people but me, a 60yr old white male walk out bags in hand and unmolested by the Walmart receipt police. Other times I was given the waive off like we dont need to check your bags. I explain to my relatives that this is just one small example of our white privilege.

(65,213 posts)There are 4 different stores where i go depending on whether i'm in that area or not.
One checks everything all the time. The other three check those items that are not bagged. I have been asked to show receipt in all 4 stores on multiple occasions. Things like big bags of pet food, 3# cans of coffee, etc. I think bagging those is an unnecessary use of plastic.
So, i'm the 65 white male who has been asked to show receipts many times.
BTW: none of these stores are in an area where it's likely there's a huge shoplifting problem. There's always some of course, but it's not like those viral videos we see of people loading up and walking out.
It's just policy and i never feel offended by it.

But, there have been more than a few times in the past few decades where I walked out of a Walled-Mart only to find a line of people having to show their receipt for the bags they had. (They all had bags, yet were being grilled anyway.) I was given the wave-off. The Hispanics behind me were not. The white dude behind them was. Just another normal day in America, regardless of what the propagandists want you to believe.

(9,390 posts)I never let them check my receipt. Even when they ask for it. In California, there's no law that says that have the right to. Membership stores like Costco do (since when you become a member they make you agree to do that). I think one employee a long long time ago followed me out to my car, but beyond that, I won't let them check. I may keep the receipt out in view, but I won't stop.

(6,254 posts)a case of water that wasnt on the receipt. Another time, by accident, at a different Sams Club I bought 6 big lamp posts and piled them on a flat bed cart. Apparently, I only paid for 5 cause later that day I received a call from Sams pointing out that I only paid for 5 and asked me to return one lamp or pay. I really had no idea and just paid for it. I suspect they checked the check out camera and because the way they were stacked it looked like only 5 when there was 6. I tell that story to the receipt checkers at Costco and their like really they caught a case of water in disbelief because they pretty much fake count. A caveat is that my wife and I spend a lot of money at Costco so they know us well. We tease and say we are going to Costco to buy the $500 chicken because we go there to buy a chicken and end spending $500 on other stuff.

It's a balance between not discouraging legit calls while discouraging abuse.

(46,354 posts)Wal-Marts vary from place to place, sometimes extensively.
I have a friend in a semi-rural area of Georgia, the Wal-Mart there is chronically short of things he needs or wants.
And the employees there have a "I don't give a damn" attitude about stocking the shelves, cleaning the store, or shoplifters.
Just the opposite here in Sheboygan.

(58,785 posts)The purpose to this law is enabling "civil actions" by victims against abusers. Malicious misuse of the police to harm others is almost certainly a crime under criminal law everywhere.
(a) Infringe on the other person's rights under the Oregon or United States Constitutions;
(b) Unlawfully discriminate against the other person;
(c) Cause the other person to feel harassed, humiliated or embarrassed;
(d) Cause the other person to be expelled from a place in which the other person is lawfully located; or
(e) Damage the other person's:
(A) Reputation or standing within the community; or
(B) Financial, economic, consumer or business prospects or interests.
(2) Upon prevailing in an action under this section, the plaintiff may recover [compensatory] damages, including damages for emotional distress [p]unitive damages [and] reasonable attorney fees .
There are apparently similar proposals in other states

(46,761 posts)I just got profiled in Orlando a month ago when I went to a running store for shoes. But that experience was nothing like the experience I had several years ago when I went to a jewelry store in Winter Park to try to sell gold jewelry. Traumatized by it to this day.

This was when all the big businesses were posting support BLM statements including michaels.
