Trump will do anything not to go on trial or go to jail. He always fights until he knows he can't win, then he makes a deal. Trump does not have a reasonable defense in the secret documents investigation.
I believe Garland would like to avoid a trial if it's possible to nail Trump without one.
The question is what kind of plea deal that would satisfy everyone.
Home confinement, banned from holding office forever, admit to all crimes under oath, are just a few ideas.

They will roll out all of the Pigs possible maladies for the sentencing. The Pig won't like being seen as frail or weak but he will do it to keep his ass out of prison. Fine the crap out of him, home confinement and probation, that is it. And not holding office anymore, if they can make that stick.

(11,744 posts)As you said, part of the pleasure for BTK was discussing the details of his crime. A psychopath is typically driven by the pleasure of committing the crime, getting away with it, then reliving it, which is why most keep "souvenirs".
Trump is more driven by the need to not be seen as a "loser". He was the least apt, least smart, and potentially least successful of his siblings. Brutalized by his father. The criminality in his personality was more likely a result of wanting to please his father, then maybe he started to like the feelings inspired by criminal acts and "getting over" on people.
Different mechanisms for BTK and Trump.
Keep in mind that BTK was kind of an "ordinary Joe", but likely a high IQ. He was able to plan and execute brutal murders without anyone catching on until they caught on. Not even his family knew what he was up to.
In my opinion, if Trump had not been born into a wealthy family but had a similarly abusive upbringing, he would likely have ended up in prison or dead a long time ago as a petty criminal. He isn't really academically intelligent or exceptional in any way. He is a half way decent con artist, and again, a lot of it is in the resources he has had to be a con.

Petraeus did it. That's how he avoided jail.
That is IF they find no evidence of him selling the info, etc.
Then Trump will lie about it in the media.

(16,860 posts)The administration should tell Trump that if he wants to make a deal, he has to do it before his followers start doing various crimes in protest. I'd hold him to the letter of any agreement too. But I think he should be in custody already. Should we wait until he incites riots? And I think he should not be allowed to use electronic communication or talk to the press.

(11,744 posts)He has NEVER been intelligent. He has gotten as far as he has based on his lack of scruples and his family's wealth. If Trump did not have his family's wealth, he would have ended up in prison as a petty criminal, or dead.
I do agree that a deal would be acceptable and appropriate. The admission of guilt, mandatory. Confinement at home, acceptable. No ability whatsoever to make any money off of this situation, like you said, a gag order. No books, no social media, nothing that would promote any deceptive reframing of the situation that would financially benefit Trump or his children. I don't know how that would work, but I would want to see them all have to give only the truthful telling of that idiot's history.

(19,140 posts)And if I were the justice department I'd give him several conditions that keep him quiet going forward. He cannot discuss or mention the case or he goes directly to prison without so much as a hearing. He cannot run for office. He cannot be involved with a political party. Etc.

(7,863 posts)I think Garland wants to indict..how does he not when so many of those who committed far lesser crimes involving national security were/are serving time...I think negotiating a plea deal would happen only after Trump is arrested..and while Trump's lawyers and the DOJ slog through the particulars, Trump should be placed under house arrest, gagged, phone seized, all communication through lawyers, no interviews, no speaking through proxies, no social media platforms
as for a trial..Trump would relish grandstanding, accusing the judge/Garland/the FBI/Biden/Harris/Antifa/the Libs,/Adam Schiff,/Liz Cheney/Mitch McConnell of conspiring to bring him down...2020 stolen election, perfect phone call, perfect documents, the most unfairly prosecuted innocent man in the world..blahblahblah...
as for what would satisfy me...confiscate all property with the exception of his primary residence.. seize bank accounts/investments...no Secret Service protection, pensions and perks denied...once a plea deal has been reached I want that sonofabitch standing before a judge reading a statement confessing to espionage, sedition, treason, and insurrection

(22,920 posts)but, in all seriousness, Trump + Co. are the most dangerous criminals the US has ever faced. They have overtly, deliberately, and often loudly (Bannon) been attacking democracy itself. Given the events of the last six years and the huge number of conspirators involved at dangerous levels, this is where Gitmo could be put to good use. If any of the more high-profile MAGA people are imprisoned stateside, their cult will use those locations as flashpoints (one of many, no doubt). Getting them into a secure location like Gitmo seems wise, for all involved, after they've had their due process.
