She will still apooint one, based on rules established by the court.

Basically, the person has to be impartial, not a convicted criminal, and meets whatever criteria she establishes for the specifics of this case.

Basically, she will have a pretty free hand. Unless there is something in the persons past the doj can object to, the choice would stand.
