President Trump told the Eleventh Circuit Court of Appeals in a Tuesday filing that as a former President, he still gets to say which government records belong to him and which do not.
Its mostly a rehash of claims that Trump has made throughout his bid to slow down the DOJ investigation into his decision to take reams of federal records some highly classified from the government. He asked the appeals court to reject a request from the DOJ to allow its investigation to go forward, as it pertains to classified records seized from Mar-a-Lago in August.
Much of Trumps argument focuses on the question of classification.
He has conspicuously declined to state that he declassified the records that he took with him to Mar-a-Lago, and potentially elsewhere, after his term in office expired in January 2021.
In a sense, Trumps statements and representations to the Eleventh Circuit miss the point: the DOJ obtained a grand jury subpoena, and then a search warrant, for records that bore classification markings. That is separate from the question of whether the records themselves are classified or not.
But in the Tuesday filing, Trump asserted that even if the documents he took bear classification markings, they may still belong to him.

For example the partially unredacted search warrant affidavit states that certain documents with classification markings allegedly contain what appear to be President Trump's handwritten notes. A57-58. Those notes could certainly contain privileged information; further supporting the need for an independent, third-party review of these documents
So they're saying, just because he might of scribbled on some classified documents, they're now his. That's like, as a little kid, your older brother licking an ice cream cone that your mom bought for you, and saying it's his now.

trump is just up to his old tricks of filing every motion he and his lawyers can think of to delay and drag out the case. Apparently he hopes to declare his candidacy for '24 in hopes that'll make the DOJ back off.
It won't work this time. Neither the special master nor the 11th Circuit will bend to his will like the corrupt and inexperienced Judge Cannon has.

He is desperately trying with all his might to concoct and fabricate a scenario where he stole government top secret documents, but because he was "His Majesty The President'e" that gives him complete and total immunity from any/all criminal actions or prosecutions against him - into perpetuity.
Those documents were part of the royal records and should be permenently stored at the royal archive offices located in the royal storage rooms at his royal castle beach-house mansion at Mar-a-Lago.
This was done by his royal decrees.
The King/Fuhrer/Pricktator has spoken.
BOGUS CRIMINAL CASE CLOSED.

(6,939 posts)He might as well have done it (like sharpied SOLD TO PUTIN, SOLD TO MBS on them, like accounting docs, and added a fake date later?) while he was FPOTUS and he has no evidence of ... anyway, all this QAnnon-originated shit is NOT relevant to the crimes listed in the Affidavit that led to the legal search warrant (since he doesn't claim he declassified any docs to the Court, but he very well 'may' commit that other crime in total desperation later on).

I suspect he hopes some error will occur down the delay tactics and the case will be tossed out at that point.

(82,849 posts)His only hope is to stall, obfuscate, lie, and stall some more in hopes of being elected in 2024. Every other avenue leads to a jail cell for the former guy. He hasn't been accountable for any of his criminal actions to this point, and he's not about to start being responsible now. He tells one story in public, another in private, and yet a third in court filings. What he said Monday morning can be contradicted 180° on Tuesday. Sometimes he'll change his story completely from morning to afternoon, or even in the same sentence. It's all he's got, except for revving up his nitwit brigade of delusional supporters.
So he's got to stave off the day of reckoning, hoping against hope that in the next two years he will transform into a palatable candidate for president. Considering he lost the popular vote by 2.8 million in 2016 and by 7.1 million in 2020, he's not exactly trending in the right direction. For the "that was then, this is now" crowd, what has he been doing in the 20 months since he left office that is going to change any voter's mind in his favor? He's certainly shed some of his supporters with his erratic and hateful behavior. How does he turn around seven million voters, especially with the increase in young voters energized by being consigned to second class status by the Republicans?
He's a sad, broken little toy, stuck in the corner and winding down.

(10,053 posts)If the 11th Circuit decides against him, he will appeal to the Supreme Court and who knows what they will do. If Trump can delay until 2024, he no doubt thinks the mechanisms are in place to ensure a Republican president, who will quickly pardon him. I doubt Trump will run again unless Republicans in key states like Michigan and Arizona assure him that the fix is in and they will send a slate of Republican electors to the EC no matter what the real vote is. Trump knows well that what matters is who counts the votes.
