Great update from Rob Reiner on SCOTUS arguments today...

Was at SCOTUS today for the oral arguments on whether State Legislatures had the power to choose electors that would negate the will of the voters. Talked with Judge Lutig afterwards who feels there’s a good possibility we win this 9-0.

For the Supreme Court to rule that State Courts had no power to hold state legislatures to the laws of their Constitution. It would be a power grab by the executive branch.

To maintain a balance of powers, the Court would need to rule that State Legislatures must adhere to the Constitutions in their States, and to maintain a one-person, one-vote standard, to choose whom the electors to the Electoral College should be, from the majority.

In my opinion, this is what the Supreme Court should rule, but how would they rule if they were caught up in a partisan fever?

I think it will be 7-2. You can't carve out elections and say that you get to violate checks and balances and the seperation of powers just for elections and if you try then you open the door for later removing that concept which then means SCOTUS just decided to limit it's own power. Honestly I can't believe that there were lawyers willing to argue this case to them.
