Donald Trump Should 'Plead Insanity' If Indicted: Laurence Tribe

Harvard law professor Laurence Tribe said Sunday that former President Donald Trump should "plead insanity" if he was indicted for the events surrounding last year's Capitol riot.

"If this is the 'defense' at Trump's forthcoming trial, I don't envy the lawyers who agree to represent him. They'd better be psychiatrists expert at reflexive projection and capable of getting their client to plead insanity," Tribe wrote on Twitter.

The law professor was commenting on Trump's reaction to the report that was released Thursday by the House select committee investigating the riot. The attack on the Capitol started after a mob of Trump supporters stormed the Capitol building on January 6, 2021, to try to overturn the certification of Joe Biden's Electoral College victory.

The committee determined in its report that "the central cause of January 6th was one man, former President Donald Trump, whom many others followed. None of the events of January 6th would have happened without him."

While his sanity is suspect, I don't believe that absolves Donald Trump.

2. Insanity defence should just adjust post trial setting

If you do the crime you should do the time, I'm ok with the former guy going to the looney bin. I'm aware there rare cases like diabetic low blood sugars and other truly out of one's mind that can absolve guilt. In t45's case he was watching the events unfold, ordered there to be no photos of himself, and he made no effort to stop it until it was going to be subdued anyways. So I'm not buying his being totally innocent, but he's still guilty of incitement even if he had a deranged theory of being robbed.

If he pleads insanity, they’re not going to say, “oh, you’re a loon? Have a nice life then, door’s over there.”

Instead, if he stages a successful insanity plea they can put him in a Federal Medical Center until he’s fit to stand trial. So…rather than 20 years in prison, he could do eternity in FMC Devens.

Love most of your opinions Mr. Tribe, but the insanity defense isn't going to fly this time. Tfg did not want to give up power and he was willing to do every criminal scheme imaginable to keep it. Let's not forget it wasn't just January 6th or even right after the 2020 election when the criminal activity began. He sent his goons to Ukraine to shake down Zelenskyy. He lied about covid and now over a million Americans are dead. He gutted the US post office. He got the entire republican party to stop voting by mail, and God only knows how many of them cheated due to his projection. He unleashed a whole army of crazies on this country. He threatened state officials. He tried to get my county's votes tossed. He needs to pay. I want justice.

The whole idea, plan, for J6 was stupid. Many of his lawyers, his AG, told him so. He made the decision to go along with his crazy lawyers. The coup of fools.

Taking secret documents home with you and leaving them in your desk, when you know the DOJ is looking for them is beyond stupid.

Trump is a genius, ask him he will tell you.

I think he's saying that the current excuses he is using to defend himself are so bad, they come off as insane. It's basically a kinder way of saying that Trump is an idiot, and there's no way in hell he's going to be absolved if he uses his current defensive tactics.

Tribe’s tweet was a snarky (appropriately so) response to Trump’s post J6 report release. Tribe knows that Trump’s lawyers will make actual legal arguments in challenging ant criminal charges not merely parrot Trumps ranting.
