The order from the Supreme Court makes it clear that it does not affect what the Federal Government does with Title 42.
The first sentence of the second paragraph states
This stay precludes giving effect to the District Court order setting aside and vacating the Title 42 policy; the stay itself does not prevent the federal government from taking any action with respect to that policy. (emphasis added)
Will the Biden Administration change the policy or use this order from the Supreme Court to kick the can down the road...

(78 posts)In the early days of the COVID pandemic, the CDC used it's authority to create a policy where certain classes of illegal/undocumented immigrant were to be ejected from the US without any action on their asylum claims. The justification was to lessen the introduction of infected individuals into the US. This occurred during the Trump Administration.
The policy has been kept in force since the change in administration. An immigrant sued the US Federal Government in the DC District Court that Title 42 was a violation of equal treatment. The District Court said that Title 42 was illegal and needed to stop.
Several states tried to join the court case and asked that District Court order be stayed (paused) while they appeal the decision. The stay request got to the Supreme Court.
The Supreme Court decided today to decide whether the states can join the case. While the Supreme Court is making this decision, the District Court order is stayed (paused).
However, the Supreme Court said that the stay does not affect any changes to Title 42 that the Biden Administration wishes to make.
