D.U. Legal/Legislation experts - could states pass anti masking laws for ICE?


Just watched another video showcasing the thuggishness, brutality, and utter disregard for the law being carried out nationwide.

Is it possible for states to enact laws requiring these gangsters to identify themselves and show their faces?

If it is, blue state governments need to get off their asses and get it done, fast.

I would very much like anyone who knows to let myself and other DUets know any and all legal measures being undertaken to rein in Steven Miller's gestapo.

And I'm pretty certain targeting Latinos and other brown groups of people is a dry run for the end goal of doing the same for all who dissent.

I am still in shock that Democrats were in power and allowed this to happen, because they felt compelled to respect institutional norms that were happily smashed shortly thereafter.

...highly doubtful they could enforce it though. State/local governments don't have jurisdiction over federal law enforcement.

Don't have a license to commit crimes, I'm pretty sure.

It's more a matter of being willing to enforce it.

As we've seen with the LAPD, with most law enforcement, there is an "us against them" mentality.

Federal law enforcement is immune from prosecution under state criminal laws if they are carrying out federal law enforcement duties.

The wearing of a mask would have to be consistent with what their supervisors are telling them to do in order to pass the two-pronged "Neagle test" (which is almost 150 years old and literally kept a federal officer from prosecution for murder)

As we have seen, they can refuse to cooperate or assist feds.

It would be interesting to see if local LEO’s could detain masked, armed individuals not wearing uniforms. Most do have vests that say “ICE” or “POLICE”, but anyone can buy those, so…?

(lawyers may point out flaws in my knowledge/logic/etc)

yes local law enforcement CAN enforce laws/arrest feds…dui/speeding/breaking&entering etc

they can’t go around breaking laws just because of the office their checks come from.

so some might say “well, they are doing official duties…locals can’t stop that”

yeah, probably…but that would require that they are identified as being feds…badges w/ identifying numbers, names, etc.

otherwise, how would the locals know they were feds? in any OTHER situation, ID is like crack-laced-with-heroin-laced-with-acid to cops…gotta gotta gotta have it! whether required or not! gotta have it! jaywalking? ID. noise complaint? ID. don’t like the way they were looked at? ID. merely walking? ID.

so c’mon…tell me again why locals can’t ID those feds.

...of an LA council meeting, it appears, based on the comments of the LA Police Chief, local law enforcement knows when and where ICE is coming in. It came up because a city council member asked the chief if there was a way for him to let local leaders/communities know when ICE is coming in since they know...he said no, it would be illegal for him to do so.

Based on that, it seems very unlikely that cops are just going to try to stop ICE or CBP officers and make them show ID when they're about to engage in an enforcement action.

I mean the streets belong to the state not the fed. And if you wanna drive on our streets you have to have a license.
