Tennessee and Iowa, along withAlabama, Alaska, Arkansas, Florida, Georgia, Idaho,Indiana, Kansas, Kentucky, Louisiana, Mississippi,Missouri, Montana, Nebraska, North Dakota, Okla-homa, South Carolina, South Dakota, Texas, Utah,West Virginia, and Wyoming, thus face significanteconomic, health, and public-safety issues from poli-cies holding out a “powerful incentive for illegal migra-tion,” Pet. 9, beyond what the Citizenship Clause re-quires.1 The States of Tennessee and Iowa, et al., notified Counsel ofRecord for No. 25-364 and No. 25-365 of their intent to file thisbrief and requested their consent on October 19, 2025. Counselfor all parties in both cases consented to the filing of this brief,waiving any objections to the timing of notice under Sup. Ct. R.

And ignore the 150 years of precedence after it became ashes. I hope whatever judge pulls this case isn’t MAGA, though I’m sure the DOJ will attempt to get it before SCOTUS, skipping lower courts.

Fully half the States want there to be a permanent underclass of non-citizens, is that it?
Let me guess: because citizens should be white Christian males, is that what they have in mind?
