Updyke receives 3 years for Auburn tree poisoning

OPELIKA, Ala. —

The Alabama fan who poisoned the iconic Toomer's Corner oak trees at rival Auburn has been sentenced to three years in prison.

Harvey Updyke Jr. pleaded guilty on Friday to criminal damage of an agricultural facility. The sentence requires him to serve at least six months in jail and spend five years on supervised probation for the Class C felony. He has been credited with 104 days already served.

Lee County Circuit Judge Jacob A. Walker III also fined the former Texas state trooper $1,000. The probation terms include a 7 p.m. curfew and prohibit Updyke from going onto Auburn's campus or attending a college sporting event.

Auburn fans traditionally gather at Toomer's Corner to celebrate victories, and the case further highlighted the emotions in the year-round in-state rivalry during the two-plus years since Updyke was arrested.

Should have just started a timber company, cut them down, sold them, and got a fine.

Moral of the story, if you want to do bad and not go to jail, start a company first.

Then, he could do community service around Tuscaloosa, since he claims to love the Tide so much.

Bastard's not even an Alabama alum, just a fan-boy. Pathetic.

And I take back what I suggested about him doing community service around Tuscaloosa. Apparently they don't want his sorry ass anywhere out there, either. Seems the university and the city took some initiative and have banned him for life from all community and sporting events on their premises.

This is vicious vandalism and no, comparing it to the ugly deeds of some logging companies does not and SHOULD NOT diminish the ugliness of that act.
