1: Free speech only applies when the government is the one trying to shut down the speech. Speech between private persons is not protected under the Constitution.
2: Free speech does not include offenses such as libel or slander. I suspect that she may well be sued on those grounds so no, the slanderer doesn't get off scot free.

(65,616 posts)just like your silly argument that people cannot have an opinion - keep it up not like it matters at all in the least bit. Nobody is going to sue her, you can pretend all you want to.

(14,739 posts)Having an opinion is not the same thing as making a slanderous statement about another person that other people hear (or see).
You can say something like "I think Joe is stupid" all day long. That is your opinion and there's nothing legally harmful to the individual you called stupid. But if you publically say that "Joe is a murderer" (or a child molester, or a pedophile or a drug dealer) it's slander and you can legally be held liable for it if the person you slandered choose to sue you unless your statement is true.
Educate yourself a little about the law.

Later, I learned she was a right wing tea bagger. The decent people of Florida (the Democrats) don't deserve public servants like so many of the ones they have.
