In June I was rear-ended, and my vehicle totalled. The person who hit me was uninsured, so I used my insurance to recover most of the cost of my vehicle, and then replacing it. Within a week of the accident, my insurance company had a check in my hand and I proceeded to find another vehicle similar to the one I lost. The vehicle I found cost me $2500 more than the insurance check even though the vehicles were nearly identical excluding color.
The person who hit me settled with the insurance company since then. I am still out the $250.
Today I go to the mailbox and there was a letter from the person who hit me wanting me to tell the state that there is no harm done and that she ows nothing as a result of the accident. She also wants me to say that there was heavy rain that day imparing travel. Her concern is that it will effect her driving record and employment as her employer reviews their driving records.
So what should I do?
Respond and point out that 1) I am out the $2500 due to her rear ending me, and 2) It was in fact not raining that day rather it was a very sunny day?
Or do I just not respond?

(4,217 posts)This would involve your lying for her. I would not do it. I know you said the case was closed but your statement be used against you. The whole thing reeks of potential trouble. Don't give away your integrity.

The other driver is not going to pay you anything. Let the driver sweat it out.

She is looking for an excuse is how I see it, afraid of the points it will cost her.

Don't feel bad because someone who is causing accidents and getting people to lie to cover up for them should be fired (assuming driving for work is the reason they check).

I am sure she was on her way to work when she slammed into me, the hospital was just a mile down the road.
She was probably running late and making a few last minute texts on her way, althogh I can't prove she was on her phone.
I had been stopped for a few minutes when it happened.

(7,745 posts)I get them to start texting somehow (a rouse) and when they are distracted have increasing hilarious things happen while they are totally oblivious. Then text them the pictures you took and say still think you can text and drive.
But seriously, texting is one of the worse things that you can do while driving.

(60,334 posts)Pulled up along side a car at the stop light Friday the young lady was brushing her teeth with one hand and had the phone in her other hand. I blatantly asked her through the window how she could drive hands free.
If I have to share the road with these idiots, I am going to be obnoxious when I can make them aware their stupidity shows.

bear the consequences of such a signed statement.

I would say financial obligations were met, if I had my $2500 back. I will not lie about road conditions.

However, hang onto that letter just in case she comes up with the fiction that you stopped short in front of her.
If you know the number of the police report, write it on the top of her letter. The police report will cite conditions at the time.
For now, ignore her and hope she's learned the lesson of why cell phones + moving cars are a bad idea, my guess for why you were rear ended.

(22,541 posts)You are out a lot of money. You should try to recover that money. Answering the way she wants you to answer could jeopardize your chances.
Msanthrope is an attorney. She won't be your attorney. But she might tell you what any attorney might say under Similar circumstances.

(60,334 posts)My gut say to respond that her obligations are not met as it cost me $2500 and that I would only make a statement they were if she covered that expense.
Any statement would make it clear what the weather conditions were that day. I would not set my self up for fraud. That would make it worse than the $2500 it has already cost me.

I just don't see how letting her off is my responsibility, forgive, yes, but one has to be responsible for their own actions.
