I changed the headline to "delete" rather than self-deleting post 'cause it will sink fast enough this way, but I wanted to explain the situation to anyone misled by the original post (now in in gray box).

I was misled by CNN (and CNN.com) on the topic. Upon further research, it appears that the NICS/NCIC system is unaffected by the shutdown. (At least in the short term) Federal background checks will proceed as usual.

No federal background checks will be done.

Actually... I'm surprised they haven't done something about this. Or have they?

Is there a provision that if the Feds haven't responded by hours X you get to buy the gun?


If so, get working on the "Felons lining up to buy guns under Republican shut-down" stories.

There are plenty of ways to get a gun without going through a background check... The good ol NRA makes sure of that shit.

Air-traffic controllers, Transportation Security Administration workers who screen passengers and other transportation safety work would continue. So would activities to preserve health and safety such as food inspections and oversight of hazardous materials. Background checks for gun purchases would continue.

as well as being used for background checks for gun purchases. It is not continuing just because of the background checks.

ATFE deals with National Firearms Act (aka Title 2 of the Gun Control Act) items that has been slow since the 1930s because they still do it "the old fashioned way".

A dealer can sell a gun three days after he submits a background check if NICS does not specifically return a "no" response. In other words no reply means "yes"

The system default favors gun buyers - which is why NICS will still be up and running during a shutdown.
