A Modesto-area soccer coach was sentenced to one year in jail after pleading no contest to raping one of his 16-year-old players as she lay unconscious at his house party.
The coach, 45-year-old Timothy Lyman of Oakdale, was also sentenced Tuesday to three years probation and will be required to register as a sex offender for life.
Whoever would do this to a 16-year-old girl is just sick, the girls father said, according to Stanislaus County Deputy District Atty. Annette Rees. This devastated my family. Lots of sleepless nights for my daughter. Sleepless nights for myself. Its just sick."
Oakdale police said Lyman had sex with the teen Dec. 27 last year after she passed out in his home, where he was hosting a holiday party. Lyman, who was the only adult at the party, allegedly furnished alcohol to underage drinkers, including the victim, the Bee reported.
Prosecutors argued in court that the girl was intoxicated when she fell asleep on a bed. The girl testified that she awoke to find Lyman having sex with her. She told the court she was in a state of shock as Lyman continued while she was awake, the Bee reported.

A year for rape? I thought you could get a year *just* for providing liquor to minors??

(22,336 posts)1. "Had sex?" No, you did not "have sex with" anyone. Jesus Christ. Even if she'd been an adult, you can't "have sex with" someone who is unconscious. That is so clearly rape and so obviously something done to and not with someone.
2. Contrast this to the people in the thread who are in prison for life for non-violent crimes.
3. I'll go out on a limb and say that the coach is probably white.

(666 posts)Not only is the act of rape reprehensible, but as her coach, he was in a position of authority and power over her. They should have given this sick fuck the maximum sentence allowable.

What good does it do to keep non-violent people in prison? Prison is for people like this rapist.
But no no no, drugs are BAD - so bad you'll go to prison forever! But rape is barely illegal. It's hard to even get arrested for it, let alone convicted, and then if you do get convicted, even if the victim is a minor, was unconscious, and you were in a position of authority over her, you'll still only have a short stint in the county jail.

(30,247 posts)This is something teenage boys and men need to get it into their heads. If the girl/woman is not conscious, she can't consent to having sex. Therefore, forcing themselves on a passed out person is called RAPE.
In this particular case, the rape is even more egregious because it was committed by an adult on a minor. He should have been protecting these kids, not getting them drunk and raping one of them. That he only got a year for the rape is ridiculous.

(2,338 posts)I would be doing life in jail for killing that fucker. And to be honest.... I would serve it gladly after wiping my ass with his entrails. I was raped. The trauma NEVER goes away. It is, in itself, a life sentence of pain, misery and self-disgust. Nothing makes that go away.
This is one person who best NEVER come across me!

This is some plea bargain shit that the lazy-ass D.A. pulled. I know that scenario too well.

30 years ago I was renting an apartment maybe 100 miles from there and a predator broke in, but we chased him off. The police informed us that this guy had just been released from serving a 7 yr sentence for rape and attempeted murder. He had not succeeded in killing the woman only leaving her paralyzed for life! 7 years for this violence? And here he was breaking into our place? And they wanted us to stay and call them when he broke in again so that they could arrest him in the act....we moved out immediately.
But the poor woman in Florida gets 20 years for shooting a warning shot when her abusive husband was getting ready to beat her up a mere week after giving birth......
Simply outrageous.

(2,201 posts)My understanding is that pleading no contest isn't an admission of guilt, but just an acknowledgement that the prosecution probably has enough evidence to have you found guilty.
I'm guessing the guy's guilty as hell, but the prosecution wasn't positive that they could convict him, so they let him plea. Or there was no way they could find him guilty without the victim testifying, and the decision was made not to put her through that.
Either way, I think the guy got off easy. I'm against the death penalty, but I'm for more sentences of 'life in prison'. I'd be happy to pay a few more tax dollars to make sure guys like this never walk free again.
