I joined 44 of my Senate colleagues yesterday in filing an amicus brief in the U.S. Supreme Court challenging the constitutionality of President Obama’s so-called “recess” appointments to the National Labor Relations Board (NLRB) in January 2012.



This brief reaffirms what my colleagues and I have been saying all along: these so called “recess” appointments are an aggressive power-grab that flies in the face of our Constitution. Since the President made these appointments, three lower courts have ruled them unconstitutional. Americans are growing tired of this Administration’s relentless overreach. The power of the President is not limitless, and this case is an important reminder of that.
