Well for now, anyway. But still!
Both the 10th District Court and now Judge Shelby have denied Utah's emergency stay.

But my concerns about those rejoicing and marrying remains the same. The state will appeal and the appeal will be heard. Should the state win the marriages performed are in jeopardy. Would a court overruling the district court decision determine to invalidate those marriages? That is a distinct possibility.
The trial judge made a poor decision in not staying his decision pending appeal. He has now placed those marriages in jeopardy. While I am excited for those Utahans to marry I would hate to have their joy turn to dismay if they are eventually invalidated.

The USSC will likely not hear the case or will merge it with cases from other circuits. The USSC decision in that scenario is a foregone conclusion because there are no issues with standing from the defense.
