are not having a good day. Their Mormon underwear are all twisted up.

But my concerns about those rejoicing and marrying remains the same. The state will appeal and the appeal will be heard. Should the state win the marriages performed are in jeopardy. Would a court overruling the district court decision determine to invalidate those marriages? That is a distinct possibility.

The trial judge made a poor decision in not staying his decision pending appeal. He has now placed those marriages in jeopardy. While I am excited for those Utahans to marry I would hate to have their joy turn to dismay if they are eventually invalidated.

The federal appeals court will use the Windsor decision along with the circuit court decision to keep the state ban tossed. The USSC will likely not hear the case or will merge it with cases from other circuits. The USSC decision in that scenario is a foregone conclusion because there are no issues with standing from the defense.

That they can do while they ultimately turn around and rule it unconstitutional at a later date. The hope is that the stay will continue to be denied as they appeal - which could take years.

Kentucky has a pending suit as well, but the Democratic AG is homophobic and is making attempts to block the case.
