Westgate sues workers who battled company in wage action



A long-brewing legal battle between Westgate Resorts and its salespeople has escalated, with the Orlando-based time-share company suing the former employees to get back thousands of dollars in commissions it paid them years ago.

The company, owned by David Siegel, has filed suit against dozens of former workers in Orange and Osceola counties, saying they were overpaid commissions and owe money to Westgate. Nearly all of the people being sued have one thing in common: They were part of a class-action lawsuit alleging unfair pay practices that Westgate settled this past August.

Michael Marder, an attorney for Westgate, said the people being sued were selected because they owed the company and that the suits were not retaliatory.

"When people are hired, they are paid a certain compensation rate. If they receive money to which they are not entitled, my client has every right to recovery that," Marder said, adding later, "I don't believe we have to justify what actions we take to recover funds."
