A Douglas County prosecutor said Thursday that a woman convicted of causing the death of an infant might not have committed that crime if a previous day care employer had reported suspicions of abuse.

Beth Beninato, an assistant prosecutor with the Douglas County Attorney's Office, asked a judge not to impose a sentence for Jennifer Schmaderer's failure to report suspected child abuse until the judge could “see the whole picture of the police investigation.”

Douglas County Judge Marcena Hendrix, saying she hadn't had time to read all the reports, agreed and set Schmaderer's sentencing for July 24. Schmaderer, who pleaded no contest to the misdemeanor charge, faces up to three months in jail and a $500 fine.

By entering a no contest plea Thursday, Schmaderer was found guilty of failure to report suspected child abuse by Sarah A. Cullen. Schmaderer, 38, employed Cullen at Grow With Me Childcare and Preschool near 120th and State Streets in 2012.
