Tracy Morgan May Never Perform Again, Doctors Reportedly Say

Tracy Morgan's professional fate is in limbo, with new reports indicating that he suffered a crippling brain injury following the crash he survived this summer.

Benedict Morelli, Morgan's lawyer, told Page Six that the "jury is out" on whether the comedian will be able to perform again. He is currently in rehab for speech, cognitive, vocational and physical functionalities. Morelli said doctors don't yet know whether the wheelchair-bound Morgan, 45, will return to his previous self.

“These people are despicable,” Morelli said of Walmart executives, who on Monday said Morgan and the three friends with him were partly to blame in the crash for not wearing seat belts. “They knew that they changed these people’s lives forever and killed somebody. They’re good blame shifters. I guess that’s how they make $783 billion a year, shifting the blame.” ...............(more)

Before this law went into effect, only front seat occupants and children under 18 had to be secured.

If this were 5 years ago, Morgan would have been found Not At Fault, but, legally... while not causing the accident, there is a certain degree of injury that is attributable to not being belted in. Governor Jon Corzine went through a similar thing, when his car flipped and he was put into the hospital and rehab..., possibly the purpose for the seatbelt law change.

The driver of the vehicle is also required to ensure everyone is wearing their seat belts.

So, while I despise Wal*Mart, and thing that they would be scumbags to not own up and cover all expenses... there is the threat of covering all his "lost wages" for his remaining life... which could add up to hundreds of millions. They are probably balancing coming off as complete scumbags and paying millions versus not being complete scumbags and paying hundreds of millions.

As far as the morality of the Walmart executives, IMO there is no morality associated with capitalism. In this country the most important ideal seems to be acquiring wealth (or maintaining wealth). The behavior of the Walmart executives is no different that most other large corporations that are injecting poisons in our aquaifers, etc. Not sympathizing with the executives but pointing out that it is symptomatic of a much larger problem that is exacerbating climate change.

My best wishes to Mr. Morgan and the others injured in this terrible accident.

there is a reason we have to wear them - they have a proven history of reducing deaths and minimizing injuries. How many time have you read about a crash where the only survivors were those wearing seat belts?

WalMart was responsible for the crash. No question. However, he bears some responsibility in the eyes of the law if he broke the law and did not wear a seat belt. Civil suits are not like criminal trials - it is not a black and white guilty or not guilty winner takes all situation. Fault can be apportioned - both sides can be deemed responsible.

I think the McDonald's coffee lady was judged 10% at fault because she could have not held the coffee the way she did. So I imagine in this case, there will be a percentage of blame applied to the judgment, which I hope will be huge.

Best wishes for a full recovery to all involved, and may WalMart make enough money to pay their settlement (and then go out of business).

The accident, I am told, was the fault of the Walmart truck.

It is not victim blaming to point out that if Morgan and his friends had been wearing seatbelts their injuries would likely have been much reduced. And, assuming that they were not wearing seatbelts, his "we were doing nothing wrong" claim is wrong given the NJ law cited above.

Given that any settlements that will be paid out are going to be based on those injuries, I think it's a bit disingenuous of Morgan and his attorney to say that a lack of seatbelt use - if true - is irrelevant to the case.
