Under Conscience Rules Christian Judges Can Refuse To Marry Non Believers.

Based on Alabama logic if you are a federal, state, local judge or JP and you are Christian you can refuse to marry anyone not of YOUR religious belief based on religious freedom. That is even though you are charged with providing a service to the public as a public official. Does that mean that if you are a Jew, Hindu, Moslem or some other religion seeing a public service that you must find a judge of your religion? Or if you are an atheist you have to find an "atheist" judge.

7. Don't conflate a state marriage with a religious marriage.

The gay marriage issue may involve both these areas but the only one being debated by "the state" is the one that gets issued a state license. And it is this license that benefits the holder in terms of taxes, inheritance, social security benefits etc. Alabama is on thin ice claiming freedom from having to issue a "state" license because of some religious idea of "Marriage." I predict in June they'll fall through that ice along with the other states which have confused the state with a religion.
