Photographer Eric Smith caught this image of a man looking at his phone as the whale surfaced at Redondo Beach, Calif., and posted it to Instagram earlier this week:

(5,027 posts)sits in judgement without knowing a thing about the guy, his situation, and what he was doing. There might be any number of reasons why he's looking at his phone and not the whale which would seem completely reasonable to us. Pictures can paint a thousand words without even coming close to telling the whole story.
The picture was taken in an area through which Humpbacks migrate from December to April - there is a good chance that he's seen Humpbacks surfacing like that even that close to his boat many, many times especially if he owns the boat and is an avid sailor.
