3. There was a problem between him & the mother.

The police came to straighten that out. In the meantime, the mother saw blood and bruises. She told the cops. She also found bloody towels he used. She had a 4 year old daughter who saw it and told her.
He was arrested. Ass't DA didn't want to put kids through a trial. Nevermind that he had evidence such as DNA.
He alo DOES NOT have to register as a sex offender.

SAN ANGELO, Texas - A couple dozen people crowded under the gazebo at Unidad Park early Saturday, making posters emblazoned with messages such as, “Justice system has failed us” and “It should not hurt to be a child.”

Those signs will be displayed Monday outside the Tom Green County Courthouse, where people plan to gather at 8 a.m. to protest a recent plea agreement involving Thomas Boden.

Last week Boden, 29, received 10 years deferred adjudication after pleading guilty to injury of a child, stemming from a January incident involving a 2-year-old girl. The plea agreement resulted in the dismissal of one charge of aggravated sexual assault of a child and a charge of indecency with a child by contact.

“There is no justice for the victim,” attendee Kay Hickey said Saturday. “They suffer for the rest of their life.”

Given the medical evidence, it looks to me like it should have been charged as sexual. This was not just what a toddler said had happened - they had evidence seen by the mother, police and medical staff.
