Fox Host: Kim Davis’ Lawyer Is ‘Stunningly Obtuse’

by Matt Wilstein | 12:27 pm, September 7th, 2015

... on Fox News Monday morning, host Gregg Jarrett and his two guests were in full agreement that Davis deserved to be jailed for not upholding the law and that her lawyer’s arguments in her defense were “stunningly obtuse.”

“When she took the job she swore to uphold the law,” Jarrett said. “We rely on government officials to do that. They can’t just pick and choose what laws they like, which ones they don’t. If they were allowed to do that, wouldn’t that lead to chaos, anarchy and so forth?”

The host and his two guests seized on a statement made Davis’ lawyer Mat Staver that implied the Supreme Court did not have the “constitutional authority” to legalize same-sex marriage.

“Whether the Supreme Court has constitutional authority?” Jarrett asked in disbelief. “... Was that a stunningly obtuse statement by her attorney?” ...

Yup. Let's just peek at the document: ... The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish ... The judicial power shall extend to all cases, in law and equity, arising under this Constitution ...

where this Staver hammerhead got his JD, must be "fogs the mirror."

I'd suggest he read Marbury v. Madison three or four dozen times in order that it might sink in. It clearly didn't dent his consciousness in law school.

Hey Staver,

after hearing the mind-roastingly stupid statements he has made in public. I was quite surprised it wasn't one of the reichwing diploma mills.

He was apparently a Seventh Day Adventist preacher before going to law school. Clearly law school did not take.

What's best for his client is far less important than the battle he is waging for Gawd. I only wonder whether Ms. Davis is really an equal partner in this, or whether she is just doing what they tell her. I suspect the latter.

I don't know how much collusion is going on between the attorney and his client; I suspect they're both doing this together, though their reasons might differ on some of the details. Staver and the outfit that pays him to appear in court aren't interested in arguing the law, they're interested in courtroom grandstanding, and Davis appears to be playing along.

Because she doesn't have a legal leg to stand on, and because her refusal to sign civil (not religious) marriage licenses is obtuse to begin with.

Kim Davis' attorney, Mat Staver, is not obtuse. His actions are deliberate. The man has a very clear agenda. Staver IS A RABID HOMOPHOBE. This cannot be overemphasized. He views gays, lesbians, and trans persons - anyone outside of the strict Christian sexual ethic - as the picture of evil incarnate. He believes that marriage equality is the devil's own dark plot to destroy the Christian family.

Mat Staver has an agenda, and his agenda is to meet the evil gay plague head-on and to thwart any attempts at gay/lesbian legitimacy. Mat Staver would rather see every gay, lesbian, bisexual and transgender person dead. Staver's agenda is NOT to provide Kim Davis with proper legal counsel. To Staver, Davis is just an instrument to be wielded, just a means to an end. Staver will NOT be counseling Davis as to the best course of action for her personal well-being, but for the best course of action for his crusade. Staver is a fanatic, a rabidly bigoted, homophobic fanatic. Everything Staver says and does MUST be viewed in context with this in mind.
