Mullah Dingleberry: Here are the laws which Clerk Davis has violated

Last edited Wed Sep 9, 2015, 12:13 PM - Edit history (1)

Today class, we are taking the Great Mullah Dingleberry Challenge

Well, Gov. Mullah Mike Dingleberry, you and Kim’s husband, Goober Joe, challenged America to name and identify exactly which statutes and laws Mrs. Sharia Law Davis actually violated.

Whoop- Here they are :

Let us start at the Supreme Court level, you know, the same Court which gave America the egregiously repugnant Hobby Lobby ruling, which paved the way for your Freedom of Religion fundamentalist extremist religious tyranny crusade on America.

Article III of the U.S. Constitution :

http://constitutionality.us/USConstitution.html#art3

]Section 2. The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; — to all Cases affecting Ambassadors, other public Ministers and Consuls; — to all Cases of admiralty and maritime Jurisdiction; — to Controversies to which the United States shall be a Party; — to Controversies between two or more States; — between a State and Citizens of another State; — between Citizens of different States; — between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

Which leads us to the “Supremacy Clause” of the U.S. Constitution:

ARTICLE VI

Clause 2 :This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwith-standing.

In case you did not know, the U.S. Supreme Court ruled that Marriage Equality, re.: same sex marriage, is legal in ALL states in America. All means each and every state for you and your doofus Borg army. Meaning, even if a given state, such as Kentucky, for example, does not have a same sex marriage is legal law, it is still legal and ruled to be Constitutional. Just because 75% of Kentucky’s inbred, chromosome deficient population voted against it. That is called mob rule. Sorry, Savonarola, the Constitution trumps Sharia law.

So, the Supreme Court established marriage equality as a constitutional right.

Which leads us to the specific Federal statues which our lovely, dear Mrs. Constitution Krusher Kim Davis has violated.

The legal term for this act is called: “Deprivation of rights under color of law”

Just sayin’ that must make you, Mullah Dingleberry, puke on your Holy Bible of Bamboozlement.

So, class, here are the Federal statutes:

18 U.S. Code § 242 - Deprivation of rights under color of law

[link:https://www.law.cornell.edu/uscode/text/18/242|https://www.law.cornell.edu/uscode/text/18/242

]“Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.”

Further, in 42 U.S.C. § 1983, (known as Section 1983) provides civil rights liability for deprivation of constitutional rights under color of the law:

http://www.constitution.org/brief/forsythe_42-1983.htm

42 U.S.C. § 1983, commonly referred to as "section 1983" provides:

“Every person who under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, Suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.”

Thought you were real smart, eh, Mullah Dingleberry, with your pompous challenge. Maybe those voices in your head which you keep hearing were not from your God, but probably just the sound of drying fecal matter from having your head shoved so far up your self righteous, sanctimonious ass.

Message to all the fundamentalist religious extremist jihadists of America:

Yah, you have Freedom of Religion. It ends where every other American’s existence begins. Your repugnant claims that Restoration of Religious Freedom Acts entitle you and your religious thugs to control and manipulate American citizens’ existences and constitutional rights are the actual, factual, tangible acts of undue burden.

GRRRRR!!!!!

For a more detailed and historical account of the concept and statutes of “Deprivation of rights under color of law”

She was also acting as a government official and in that role attempting to establish the tenets of her religion as law rather than implementing the law stated in the Supreme Court decision on LGBT marriage.

Marriage is a fundamental right. Loving v. Virginia.

It cannot be denied on the basis of race or gender.

But I think that Kim was jailed for contempt of court, for failing to obey the court's order.

The court order was based on the Constitution, but if the court orders you to produce certain documents or perform an act and you don't do it, you may find yourself in jail for contempt of court. I don't know whether people understand that concept. But it is one everyone should try to understand.

JD,
Now the contempt charge was in response to her actions of refusal to issue same sex marriage licenses,
which is absolutely "Deprivation of rights under color of law"
So, Mullah Dingleberry, proclaimed his challenge to America, on various media, to name and to declare
which Kentucky same sex is legal law did Sharia Law is the Law Davis violate. He issued this pompous challenge knowing that no such law exists and he figured that no media journalists would have an answer for him. Plus his Borg flock eats this shit up

for disobeying a court order. In this case, the order required her to marry an LGBT couple.

Your explanation explains why she was ordered to marry them.

But a person in Califorrnia can be jailed for contempt of court simply for failing to appear in court when ordered to do so by a judge. I have seen that happen.

A person in California can, for just another example, be jailed for contempt of court for failing to respond to a subpoena for a deposition in a friend's divorce dispute, that is failure to respond to discovery.

There has been much confusion about why the judge put her in jail. It was not for her opinions on gay marriage. It was for refusing to obey the court's order to marry the LGBT couple. Once the LGBT couple had their license, there was no need to keep her in jail.

Yesterday, while driving home, up the coast from L.A. to Oxnard, I think I saw Sheriffs issuing contempt citations for failure to surf while there were really good waves on a great sunny day
Or, maybe it was just my imagination
Driving under the influence of a great beach day in California

THAT is a very applicable statute which needs to be charged more often , esp. in aggressive police treatment of the public, IMHO.
