The Judge said that since her office was now issuing marriage licenses to Gay coupes, she was no longer in contempt.
If she tries to halt it again, she will be back in jail.

(37,098 posts)She is still the County Clerk. But she must uphold the law and allow marriage licenses to Gay couples. If not, she is in contemp again. the judge can put her in jail and levy fines.

(21,046 posts)She failed to carry out the duties of her office, which is a state level misdemeanor, and is criminal. That's totally separate from the failure to issue marriage licenses to same-sex couples, which was the result of a decision by the Supremes which is a Federal precedent.

It's just that when she was released, with the asshole Huckabee cheering her on, she acted like she won.
She lost and has accepted the loss. (by saying licenses will be granted.)
