The Judge said that since her office was now issuing marriage licenses to Gay coupes, she was no longer in contempt.
If she tries to halt it again, she will be back in jail.

She is still the County Clerk. But she must uphold the law and allow marriage licenses to Gay couples. If not, she is in contemp again. the judge can put her in jail and levy fines.

She failed to carry out the duties of her office, which is a state level misdemeanor, and is criminal. That's totally separate from the failure to issue marriage licenses to same-sex couples, which was the result of a decision by the Supremes which is a Federal precedent.
