Judge Christina Argyres gave one 18-year-old first offender the scare of his life during his trial in a New Mexican court.
Isaiah Gay was being charged for burglarizing homes with some friends. He offered this excuse to Judge Argyres:
But she wasnt having it. She told Gay exactly what would happen to him if she sentenced him to the maximum 15 years in prison:
Judge Argyres then addressed the state, explaining that it would not be right to put the young man in prison just yet, especially since he was a first time offender:
She let Gay off with five years of probation, and a warning about his future should he mess up again

I object to this line of questioning on behalf of the defense.
I also object to exposing a child to such language.

Hell, I grew up in the 60s and I heard the term bitch before I was 12, I'm pretty darn sure.

Although if the commercials I base my research on are correct, talking to an infant decreases the chance that the infant will drop out of school and in fact go on to a carreer as a telephone sanitizer.

(5,493 posts)Rape shouldn't be part of any punishment - not even a deterrent. It seems to be an accepted part of prison life now. Surely the loss of freedom should be enough to fear.

(5,493 posts)I cringe whenever someone joyfully says, "You're gonna be Bubba's (beep)!" or similar statements. They ignore the fact that "Bubba" is the personification of a predatory psychopath who has been given free reign to continue to hurt others.

But the point is that it happens. The people that need to be held responsible, along with the rapists, are the corrections officials that allow it to happen. I've never been able to figure out why that hasn't happened.
But until/unless it is stopped, I don't see anything wrong with reminding young offenders that this could be the future they face if they don't straighten out their act.

Now if she knew Bubba Smith liked 18 year old boys, and then arranged with the department of corrections to house this kid with Bubba Smith, then she's guilty of conspiracy.

(5,586 posts)If that were the case, you could arrest everyone who ever worked in law enforcement, and countless others who were tangentially involved, like Eric Holder and other politicians.
Judges generally have wide discretion in pronouncing sentences, and one of those sentences is prison.
As long as the prison system makes a good faith effort to protect prisoners from rape, then nobody is guilty of anything. In other words, if the guards have a regular patrol or staff in place to observe prisoners to ensure their safety, then that's a good faith effort. If they've ever stopped a rape, or punished a prisoner for the raping of another, then they're even more in the clear.
All the judge would ever have to say if by some miracle they were questioned about this is that she was trying to deter the young man from committing future crime, and she trusted that the prison system would do their best to insure the inmate's safety.

The judge knows people are getting raped in her state's prisons.
And she continues to blithely send people there.
Instead of scaring teenagers, she should be screaming from the rooftops about the state of the prisons.

I was thinking about the kid who got away with manslaughter because of his affluenza, and was hoping this poor kid wasn't going to be imprisoned forever. The judge imposed consequences with compassion. Wait till the kid finds out how much fun probation is. I hope it turns him around.

This judge tacitly accepts and publicly announces her view that prison rape is neither cruel nor unusual.
