As soon as news broke of notorious hatemonger Supreme Court Justice Antonin Scalia’s death, some liberals joked that conservatives are so desperate to hate Obama that they would accuse the president of murder. The idea seemed so nonsensical that it could never happen. Sure, it was entirely expected that Republicans would immediately vow to block any Obama nominees no matter who they are. Republicans have been working to stand in between Obama and success since before he was elected the first time. But to accuse him of murdering Scalia?

Scalia, a man who opposed anything that advanced human rights at every turn, was a 79-year-old obese gentleman who smoked (factors that greatly contribute to one’s risk of death), but lived a full life — one he chose to waste opposing LGBT rights, a woman’s right to choose whether or not to have an abortion, racial equality, and other endeavors rational, thinking, decent human beings would consider reasonable.

That President Obama will be nominating a replacement is something that frightens conservatives — apparently to the point that the gerbils that operate their brains have all simultaneously died. All across right-wing social media, you can find a curious assertion repeated: that bastard Obama gone done and killed Scalia. On Twitter, several hashtags have formed to push the moronic belief that the President’s secret Muslim enforcers gave Scalia a heart attack — and there is such an outpouring of stupid, Sarah Palin will likely announce plans to speak about foreign policy for 30 minutes straight in order to regain her title as the Dumbest F*cking Human Being Alive:






Though Scalia’s true murderer is heart disease, the Right is almost desperate to believe that the president had Scalia killed. One gentleman calling himself “NatureHacker” manages to spin a particularly crazy theory that:
“This is a white house president government coverup. The fbi and cia with barack are probably involved. mercury nitrate may have been the poison of choice at dinner or the sulfate with lead, cadmium, radium, plutonium, uranium, or organophosphate. Roundup is an organophosphate that could have been used by leonard nimoy. This justice was killed and found dead. He died of a premeditated murder. Another term for this is that he was assasinated for his spot in the supreme court to be appointed by a liberal.”

Ask my wife what was my first reaction when I saw this online yesterday afternoon.

A morbidly obese 80 year old man who is a heavy smoker and drinker dies after ingesting a fat laden dinner. What else could it be besides a murder by Obama?

If liberals wanted to murder Scalia, why would they not have done it at the BEGINNING of Obama's first term, when he still had the Senate, rather than right now, years later, when Repubs hold the Senate?

I look forward to hearing from real Supreme Court experts. There is no way that I can see the President successfully appointing a new Justice.

It's still precedent. It's not uncommon that a Circuit Court of Appeals confronts a question that's been decided by another circuit but hasn't been considered by SCOTUS. In that event, the court will certainly look to the precedent from the other circuit, and it will carry weight, but the court may decide to disagree.

When such conflicts between the circuits arise, it's practically a sure ticket to a Supreme Court review. (The Supreme Court has to be very choosy about what cases it takes, but conflict in the circuits is something only SCOTUS can resolve, so it almost always does.) If the conflict is over a question on which an understaffed Supreme Court splits 4-4, then the law will be different in different parts of the country, until the Court can rehear the issue with the ninth Justice in place (or until Congress resolves the question, if it's one of statutory interpretation).

ETA: I'm a lawyer but not a real Supreme Court expert. In this post I've confined myself to the basic stuff that doesn't need an expert. Incidentally, 4-4 decisions arise sometimes even with a full bench, if one Justice has a conflict of interest requiring recusal.

With a 4-4 court (presuming that Kennedy continues to largely vote with the conservatives), the lower court decision stands. The lower federal courts have been packed with Republican appointees, with Obama's appointees stalled by Republicans in the confirmation process. Thus, I would expect there to be many decisions that we will not like.

As far as a new appointment goes, assuming a Democrat wins the election and the Senate remains Republican, which is a likely scenario, what makes anyone think that the obstruction will stop? I find it difficult to believe that the Republicans will obstruct the black man, and then cooperate with the woman who killed Vince Foster buried all those bodies in the White House lawn and the Communist. They have constructed such a strong fantasy world that it will be difficult for them to turn towards sanity without losing the support of their militant voters.

I am very conflicted about Obama making a recess appointment. There is a part of me that very much wants him to do so, for the precise reasons I gave above. At least we would have 9 justices for the next 10 months. However, this being an election year, Obama's making a recess appointment would give the Republicans a very strong talking point to support their narrative of Obama being a dictator who runs roughshod over the Constitution.

Thus, how this is perceived by the public will be a matter of which side is more effective in getting out their position. We all know that the Republicans have a large media presence and will have no problem having Fox and right wing radio spreading their talking points. Obama has not, to date, been very good at publicizing his positions and accomplishments. We must hope that he is front and center on this issue, hammering home every day that the Republicans are obstructing. If he does not, the conservatives will be voting in enormous numbers to "save their country" (and the Second Amendment, of course, the most important part) and we will need to mobilize as never before to make sure they do not win.

a recess appointment, it would be very deliberate. He will in all likelihood have no chance to make a recess appointment.

The SCOTUS decision on recess appointments a couple of years ago was that the Senate has to be in recess more than 3 days, and the Senate leadership can make sure that never happens by having a handful of people come in and address some business, then adjourn again. Over and over.

Unfortunately you are all too right that the GOP has an advantage in that much of the right already sees SCOTUS as an evil liberal tool that will take away their right to bear arms if they don't keep control. That said, most of what I've read so far doesn't seem hopeless that Obama will get a valid nominee confirmed.

In November hundreds of elections will be decided at all levels by the voters, many of whom are independents who left the GOP in disgust at the corruption and the idiocy on their right; the GOP must keep the vote of these right-leaners. There will be pressures from the ultraconservative plutocrats who are bankrolling most of the GOP's candidates and who also must be frantic at the prospect of losing control of SCOTUS, instead of gaining full control as they planned. The GOP's leadership is between a rock and a hard place and a rock.

Let's hear it for Serious Conspiracy Theories: With the exception of Elena Kagan, the entire Supreme Court is either over 60 or dead. In the "unlikely, but anything's possible" category, there is the slight chance President Hillary Clinton will have to seat seven Supreme Court justices. Can you imagine the bricks the Far, Far Right would be shitting if Hillary were able to stack the court to that extent?

Instead of raving on the airwaves. But he says he feels it in his gut.

I actually know people who believe this stuff. It amazes me. But they have a right to their opinions.

The people here are more into the Michele Bachman kind of thing. Obama is going to declare martial law and then take over for a 3rd term. And take over the UN. Then I am not sure what happens. All the believers will be killed by the guillotines they are secretly building.

It probably takes five minutes per person to perform one of these executions. Even if we built 50,000 guillotines it would take YEARS to solve the Republican Problem.

On the other hand, we have lots of guns, bombs, cannons, mortars, nuclear missiles, parathion...we could easily pack 50,000 Republicans into the Kibbie Dome in Moscow, Idaho, and bomb it flat. This would solve two problems at the same time: it would get rid of both 50,000 Republicans AND the atrocity that is the Vandal football program!

Scalia lived his last day as he lived most of his adult professional life. Unethically, getting free gifts and services from those who seek favor or access.


“I knocked on the door loudly,” said Mr. Poindexter, who said Justice Scalia and the other guests had been staying at the ranch free for the weekend. “I had him in a very large room — a suite — and I thought he might be in the bathroom.”


They probably also paid for his private plane flight.
