I would like to give an up-date on the road rage case, that I have spoken about on DUGD over the past year and a half. Its a case where many, many forum members have provided much-appreciated support to my family
..including writing, texting,and calling both the District Attorney and County Judge to demand that the accused murderer not be granted bail. We not only far surpassed the countys previous record for public imput, but the DU community set the bar extremely high.
For those newer DU community members who are unfamiliar with the case, it began on October 27, 2014. My cousin was a passenger in his sons vehicle. After having breakfast in a local diner, they were on their way to run some errands. Another vehicle started tail-gating them; as it turned out, the driver of that vehicle was enraged that my cousins son was driving at 53 mph on a curve on the highway. The young man pulled over to let the fellow go by, and within a minute, that driver would get out and shoot my cousin.
His son got out to try to save his fathers life. Thus, the gunman shot him, fatally. He then attempted to put a bullet into the back of my cousins head, but the gun miss-fired. My cousin was able to write the guys license plate number down, in the dirt on their back window. He then held his son in his arms, while the young man bled to death.
A half-mile up the road, the gunman threw his pistol towards the river. The following day, the NYS Police were able to recover it from the thick under-brush. The gunman next stopped at a convenience store for a 12-pack, and was on his way. Because he was an off-duty law enforcement officer, he had a scanner in his vehicle. When he learned the police were looking for his vehicle, he decided to go to the nearest State Police headquarters.
There, he told a story -- which the police taped -- in which he claimed the pair had been dogging him, threatening his life, for several days. Thus, he tail-gated them, so he could act in self-defense. The investigators knew that he was lying, and arrested him.
He had been a NYC police officer for 20 years, before being forced to retire. His personal files are sealed. He first became a campus security officer at a local college; he was fired from that position, for bullying behaviors. He then became a part-time guard at the county jail where he currently resides. He also had had at least four similar incidents, three for road rage, in which he pulled out his weapon. (In one, he shot in the direction of teens on a neighboring property, as their noise disturbed him.)
In my family system, my cousin is my brother. My children know him as their uncle. His children know me as their uncle. His parents -- my aunt and uncle -- are extremely close to my children, as are his three sisters. My aunt and uncle are in their mid- to late 80s. For us, this is not the first time weve had a close relative murdered. My aunt and my mothers brother was murdered in the late 1960s, after winning a hand of cards in a local bar. Fifteen years later, his oldest son was brutally murdered, over an argument about a ten dollar bag of pot. In neither of those cases was an arrest ever made.
Some of our family were afraid that this thug would skate, because of his law enforcement background. In many areas of the US, I think he would have. But the State Troopers and BCI Investigators here are honest men and women. They find this thug to be repulsive, and they understand how this type of case damages the reputation of police. They have taken the case very seriously, and we couldnt ask for more on their part.
In some up-dated news, the thugs wife filed for divorce soon after he was jailed for murder. One of my associates had a casual friendship with the wife. She said her husband was an abusive, violent, controlling thug. She had not dared to leave him, until he was behind bars.
Yesterday, the thug and his attorney informed the Court that he does not want a jury to hear his trial. Previously, he had expressed confidence that he could convince any jury that he had acted in self-defense. I suppose his attorney has been able to break through this guys delusional self-confidence.
Personally, I wish he had the decency to simply plead guilty. But he has no decency. The trial, which is scheduled to begin next month, will end one chapter of this case. It cannot, of course, bring about closure. For literally every day, my family feels the loss of a good young man, and for no reason other than this rabid jackass was angry.

(11,868 posts)Eventually through the years, a kind of numbness to the loss and anger gives some relief, but there's never really a sense of closure. That hole in the heart will always be there.

Anyway, thanks for the update and I hope justice is delivered for you and your family. It won't heal anything, but it might bring some slight peace if this monster is locked away with a life (or near life) sentence.

(20,588 posts)When a case is very emotionally charged, a defendant can choose to plead his case to the judge only. If the judge has a record of acquitting cops no matter what, the defense attorney may think that's a better choice.

(2,931 posts)After looking into it somewhat, it actually makes more sense for an innocent person to request trial by judge, since the judge should be more intelligent than 12 randoms from your county. The guilty people only need 1 of the 12 randoms to get it wrong and then get set free.
In this case I don't see why the accused would want a trial by judge. It sounds like he is obviously guilty. But maybe the other poster is correct in saying the judge is getting paid off? I guess we have to wait and see. All that aside, it really sucks for the OP. He lost a family member for no good reason and nothing will bring him back. You have my sympathies and thoughts, OP.

My younger stepson is a detective, but he is seriously considering leaving law enforcement because of the horrifying number of mentally unstable thugs and bullies that are admitted to the ranks. I suspect they are actively recruiting such people in certain areas. I am glad to hear that the police in your area are not letting this SOB skate; far too many do.

(17,504 posts)One would expect that a judge would be less easily-swayed than 12 of the defendant's peers, and that the defense's lawyer will curb his rhetoric for that reason. I personally would have a hard time sitting there listening to some advocate explain why it was all the fault of the victims.

Just as I was reading his wife filed for divorce, the thought went through my mind that she was probably too fearful to leave him. I find this very disturbing as well. I can't imagine that.
What I don't understand is how we can miss these kinds of obvious problems. I think this comes back to something I recall from another thread. About self-policing of society. Policing is not the best word. I mean at least a lower level of scrutiny in society. In retrospect, this guy was like Zimmerman. Why not legitimately try to keep Zimmermans from growing? Just like forums, the collective mind has benefits a single mind does not have. (Except maybe Stephen Colbert.) So this guy had a pattern of being malicious. In some occupations more scrutiny must be paid to recognizing behavior patterns so that this stuff can be avoided. I don't think just anyone can do that. So we need to find those who can. Ignoring those in need helps this to grow into something which becomes destructive. Can we not do better? So I go back to having a tier in society, not unlike actual family members, who have the wits about them to give (I think you said it best: nurture) proper attention to those in need. Right now we not only don't have that, but children are being raised by their peers. That, some claim, is the source of ADD type behavior.
There's also the promotion of this behavior, I just realized! That's the macho male default. But it's Trump. He's like the leader of all those kids who put firecrackers in frog' mouths. I never understood that shit. This also comes from families being raised in this competitive capitalist society. We're pitted against each other. I don't know.
We're a war nation. Resources, lives, mentality. Crazy.

I'm so sorry this happened to a good young man. More so because you loved him.

Some asshole in a giant diesel pickup (no passenger visible, but maybe I just couldn't see a second person rattling around in the cockpit of battlestar galactica there.) tailgaited the shit out of me the whole way. Not like I can pull over.
Five mph over. Still had to climb up my ass in his giant rig. I'm sure he was flipping the fuck the whole time too.

(2,983 posts)The kind of anger, hate, violence that took the life of that poor young man is sadly on the rise here in America. I have seen it even up here in northern Maine, which is commonly thought of as a peaceful place. Such people, such dangerous and delusional people, should spend their lives in prison, in highly secure facilities where their threat to the common good can be, if not removed, at least somewhat contained.
Some years ago... my Aunt was crossing the street from a hospital. She was hit by a vehicle, driven by a young man who had run a red light. She lay on the ground, injured, but seemed like she might be getting up... when the driver panicked, slammed on the gas, and ran her over. It is a medical miracle that she survived, despite being on life support, having portions of her lung removed, dealing with medical malpractice and worse things. Not only did the Driver get away (he was never caught) but my Aunt and Uncle have faced years of legal battles against a Doctor and medical staff that absolutely made her health problems and her injuries far, far worse.
It is easy to get angry when such things happen. To mock any notion of justice, to consider the world to be a dark, cruel place... and some times it can be. Remember though, when things seem at their darkest, that there are many, many people who applaud and fight for justice, who hold peace, love, and compassion strongly in their hearts.
You and your family have my deepest sympathy. I hope the crook who killed your cousin rots in prison.

Investigators say around 7:00 a.m., a man confronted two turnpike employees at exit 180, the Fort Littleton interchange , in Dublin Township, Fulton County.
The suspect is identified as 55-year old Clarence Briggs, a retired trooper with the Pennsylvania State Police. Briggs is from Newville, Cumberland County.
Officials say Briggs displayed a handgun and ordered both employees to enter the turnpike office building. While inside the building, Briggs attempted to tie up both men, when a struggle began and Briggs fled the building. Both employees left the building, and at the same time, a fare collection vehicle arrived at the interchange.
Turnpike employee Daniel Crouse, age 55, and the fare collection vehicle security guard Ronald Heist, age 71, were then shot and killed. Briggs then began to fire shots at the fare collection vehicle. The driver of that vehicle was able to flee on foot. Briggs then gained access to the fare collection vehicle and drove it a short distance on Route 522 to an area where his car was parked. Briggs attempted to unload money from the fare collection vehicle and place it in his car.
I'm really starting to wonder, myself, if psychiatric follow-up needs to be a part of police pensions.
