http://www.sunjournal.com/news/lewiston-auburn/2016/10/05/armed-auburn-woman-scares-clown/2006674AUBURN An Auburn woman reported Wednesday night that a clown in the back seat of an SUV formed a gun shape with his fingers, pointed them at her and mouthed the word "bang" as she sat on her porch.
The woman pulled out her legally carried 9 mm handgun and the driver of the clown car sped away.
It happened at about 5:30 p.m. on Gamage Avenue. The 49-year-old woman said she was sitting on her porch when a black SUV rolled to a stop in front of her house.
The vehicle's rear window went down, she said, and there sat "a scary clown" in face makeup.

(26,326 posts)She admitted she wasn't scared. I mean what reasonable person WOULD be scared of a person is grease paint making a childish finger gesture from, what? 20 or 30 feet away?
Is that the standard for waving a gun at a passing car?

(63,209 posts)You can't be charged for claiming to have pointed a gun at someone who doesn't exist, even in gunporn fantasy stories like this one.

(26,326 posts)I think the cops have a duty to act. She basically turned herself in. And I don't think a victim needs to come forward if CCW is involved.
People waving guns off their porches need to be looked in to. Who else does she wave her gun at without cause to feel legitimate threat? Neighborhood kids? The UPS driver?
If she wants to back peddle and claim she lied about brandishing a weapon then charge her with making a false police report.

(63,209 posts)She likely won't recant her story, and if she doesn't then it seems the only charge they can lay on her is brandishing, for which they'll have only her own story as evidence.
If by some miracle it does go to trial, then the NRA will send a fleet of million-dollar lawyers to overwhelm Auburn's courts to defend her sacrosanct right to do whatever the hell she wants to do with her gun, as long as she's willing to claim that she felt threatened.

(39,171 posts)that is not necessarily brandishing in the eyes of the law.
If the clown felt threatened then he can always file a complaint with the police. With no other witnesses I can see why the cops will ignore this - she would simply exercise her 5th Amendment rights leaving the prosecutors with no case.

Is it real copy-cat behavior?
I often think back to the 80's when Geraldo Rivera did a TV special about (supposedly) prevalent human-sacrificing Satanic cults, and later hearing people in my personal life express fright about that so-called threat. It was BS!
