Kellyanne Conway finally admits the audit was just an excuse

Unless Congress makes him, we’re never going to see those tax returns

Updated by Matthew Yglesias@mattyglesiasmatt@vox.com Jan 22, 2017, 1:08pm EST

Speaking on ABC News’ Sunday morning show This Week, White House counselor Kellyanne Conway finally admitted what had been plainly obvious to anyone paying attention — Donald Trump is never going to voluntarily release his tax returns, so the American people will never know who he is in debt to, whose payroll he is on, or how he is personally benefitting from the policy decisions he makes as President of the United States.

Her rationale for this unprecedented breach of norms is that “we litigated this all through the election” and “people didn't care.”

-snip-

This is, however, not true on several levels.

First all, the results of an election in which Trump finished two percentage points behind his main opponent certainly don’t support the view that “people didn’t care” about his opponent’s criticisms of her. Second, polls show that a clear majority of the public thinks he should release his tax returns.

Last but by no means least, this isn’t even the issue that was litigated during the election. What was litigated during the election was Trump’s claim that he would release his tax returns in the future, but couldn’t do so yet because they were under audit by the IRS. This was always a fairly transparent lie, but Conway herself used to get quite indignant at people who suggested the Trump campaign wasn’t being on the level.

He claimed that even though the IRS said that an audit was no barrier to releasing, his attorneys and financial advisers had counseled him not to do so while an audit was ongoing. Absent an audit letter from the IRS, he may have been lying about being audited in the first place. He is apt to lie about anything, so the odds are in favor of the whole "audit" excuse bring just another falsehood.

On "Meet the Press" this morning he had the woman my husband calls Jodyanne Jerkmeoff on as a guest. First up! About the utter stupidity and pettiness that the very first press conference given by the new White House Press spokesman in the Resident's brand new "administration" (so new it was a mere 48 hours old at the time), is devoted to quibbling and whining about crowd size. Yep. trump always has to be or have the biggest, even when his isn't. And she presented what she called "alternative facts."

http://www.nydailynews.com/news/politics/conway-white-house-offers-alternative-facts-media-article-1.2952884

And Chuck Todd actually took her to task on it. But he didn't go all the way. Didn't use the word "lie." He called it a "falsehood." Several times, too. But he didn't go all the way to "lie." He should have. Because that's what she was doing. This was deliberate. A deliberate LIE. I'm surprised he even went as far as "falsehood" but he did do at least that.

March 2007, so it's a bit on the old side. The FOIA Act is 50 years old.

Here's the website:

http://www.usdoj.gov/04foia/04_7.html

If that doesn't work, I'll get a better link tomorrow.

DUer "nitpicker" posts a lot of stuff from Justice. I think http://www.justice.gov/ might be a better starting point.

ETA: "page not found." It's too old.

Try this:

DOJ Guide to the Freedom of Information Act

The Department of Justice Guide to the Freedom of Information Act (2009 Edition)

The United States Department of Justice Guide to the Freedom of Information Act (2009 edition) is a comprehensive legal treatise of the FOIA's procedural requirements, exemptions, and litigation considerations. It contains a detailed analysis of the key judicial opinions issued on the FOIA. The Guide is prepared and updated by the staff of OIP. Any inquiry about the points addressed in the Guide should be made to OIP through its FOIA Counselor Service, at (202) 514-FOIA (3642).

It seems 2009 is the newest edition. The purple one in the lower right hand corner is the 2007 edition.

You can download the whole thing or individual sections.

Since he wasn't president last year, I don't think getting a judge to release them to the public based on that would work.

However, I don't see why they would not be released to the IC as part of an investigation. (Such as a FISA court) I would think the IC may need to know foreign connections if they want to keep the public safe from foreign influence. However, we would not be privy to that.

Next year, it may be a different story because he has been president for a year and if it appears that he is still wheeling and dealing around the world, then I can see his tax records for 2017 being released to congress.
