Trump lashes out at so-called judge

By Amy B Wang
February 4 at 9:33 AM

... U.S. District Judge James L. Robart wrote in his opinion that “fundamental” to the court’s work was “a vigilant recognition that it is but one of three equal branches of our federal government.”

Robart, a judge appointed by George W. Bush, said in his written order that U.S. officials should stop enforcing the key aspects of the ban: the halting of entry by refugees and citizens from certain countries. He did not specifically address the matter of those whose visas already had been revoked.

Following the Friday-night ruling, government authorities immediately began communicating with airlines and taking steps that would allow travel by those previously barred from doing so, according to a U.S. official.

At the same time, though, the White House said in a statement that the Justice Department would “at the earliest possible time” file for an emergency stay of the “outrageous” ruling from the judge. Minutes later, it issued a similar statement omitting the word “outrageous” ...

America began accepting foreigners from seven predominantly Muslim nations into its borders Saturday after the government stopped enforcing President Donald Trump's travel ban at airports — setting up a contentious fight with the White House over the immigration order.

The Department of Homeland Security said it will no longer force airlines to block certain foreigners with visas from boarding planes, while the State Department also announced it has reversed the cancellation of visas under Trump's executive order ...

The departments' decisions essentially back up a federal judge in Seattle who on Friday halted Trump's executive order ...

... The Department of Homeland Security "has suspended any and all actions implementing the affected sections of the Executive Order," a department spokeswoman said in a statement. Accordingly, department officials are no longer flagging travelers simply because they are from the seven majority-Muslim countries temporarily barred by Trump's order.

Meanwhile, a State Department spokesperson tells NPR that officials with the department are also adhering to the decision. The department has provisionally revoked somewhere between 60,000 and 100,000 individuals' visas, according to different accounts; under Saturday's announcement, the State Department says that move has been reversed — and that "individuals with visas that were not physically cancelled may now travel if the visa is otherwise valid."

The State Department said it is working closely with DHS and legal teams on complying with Judge James Robart's decision, which suspends the nationwide enforcement of Trump's order while a case brought by the states of Washington and Minnesota is heard in court.

Trump, for his part, tweeted a broadside Saturday morning against Judge Robart ...

6. Schumer warns Trump's attack on judge could impact Supreme Court confirmation

... “The President's attack on Judge James Robart, a Bush appointee who passed with 99 votes, shows a disdain for an independent judiciary that doesn't always bend to his wishes and a continued lack of respect for the Constitution, making it more important that the Supreme Court serve as an independent check on the administration,” Schumer said in a statement.

He added, “With each action testing the Constitution, and each personal attack on a judge, President Trump raises the bar even higher for Judge Gorsuch's nomination to serve on the Supreme Court. His ability to be an independent check will be front and center throughout the confirmation process” ...
