Sounds like they shot him, then he was taken to a hospital. The cops probably shot to kill, so it's only a matter of time before he's confirmed as dead.

In most shootings they seem to average a 20% hit rating so likely just sheer luck it was in the leg.

The driver had a BB or paintball gun but not an actual firearm.
