Man convicted of capital murder in burned boy case

GALVESTON – A Galveston County jury Monday convicted Don Collins of capital murder in a case where prosecutors said he poured gasoline over an 8-year-old boy and set him afire, causing massive burns that led to his death 13 years later.

After deliberation for nearly four hours, the seven women and five men on the jury determined that Collins, then 13, tied Robbie Middleton to a tree on a wooded trail near his Splendora home and set him ablaze in order to silence the victim of a sexual assault two weeks earlier.

Middleton died in 2011 and his death was ruled a homicide.

The jury, which is hearing the Montgomery County case because District Judge Kathleen Hamilton ruled that Collins could not get a fair trial in his home county, will next decide Collins' sentence.

Because Collins was a juvenile when the crime was committed, he faces a maximum sentence of up to 40 years in prison.

because of this fact child molestors and child murderers are often put in solitary to protect them.
