Albemarle County prosecutors have charged Jesse Leroy Matthew Jr. with the first-degree murder of University of Virginia student Hannah Graham. ... Graham, 18, went missing on Sept. 13 from the Downtown Mall. The UVa second-year student’s remains were found just over a month later on an abandoned property off Old Lynchburg Road in Albemarle County.

Matthew, 33, of Albemarle, was the last person seen with Graham. He’s been charged with her abduction in Charlottesville and has a preliminary hearing scheduled for March 26 in the city’s General District Court.

Matthew is scheduled for a preliminary hearing on the murder charge on Feb. 18 and will appear via video link, said Albemarle County Commonwealth's Attorney Denise Lunsford.

Matthew, who was indicted by a grand jury on Feb. 2, has also been connected to Morgan Dana Harrington, a 20-year-old Virginia Tech student, who disappeared on Oct. 17, 2009 after attending a Metallica concert at John Paul Jones Arena.

Jesse Matthew has been indicted on the counts of first degree murder and abduction with the intent to defile in connection with the disappearance and death of second-year College student Hannah Graham, the Albemarle County Police Department and Albemarle County Commonwealth’s Attorney announced at a joint press conference Tuesday morning. The maximum penalty for each of these offenses is life in prison.

Albemarle County Chief of Police Steve Sellers said the investigation into Graham’s disappearance and murder is now complete.

Matthew has not been indicted for capital murder, and would not face the death penalty upon conviction.

“The charges that the jury will hear are the charges that the prosecutor feels comfortable and and feels the prosecutor has probable cause to bring,” Commonwealth’s Attorney Denise Lunsford said. “In this case, first-degree murder and abduction with intent to defile.”

The Albemarle County Police Department and Commonwealth’s Attorney’s Office plan to hold a press conference Tuesday morning about Jesse Leroy Matthew Jr.

County Police Chief Col. Steve Sellers and Commonwealth’s Attorney Denise Lunsford will be speaking, according to a news release. The conference is scheduled to begin 11 a.m. in the Albemarle County Office Building on Fifth Street Extended.

In Charlottesville, Matthew, 33, is charged with abducting 18-year-old University of Virginia student Hannah Graham. Graham, who went missing Sept. 13 from the Downtown Mall, was last seen with Matthew. Her remains were found Oct. 18 on an abandoned property off Old Lynchburg Road in southern Albemarle.

Authorities have said forensics also link Matthew, of Albemarle, to Virginia Tech student Morgan Harrington, who disappeared on Oct. 17, 2009. Her remains were discovered in early 2010 a half-dozen miles from where Graham’s remains were located. ... No charges have been filed relating to either death.

CHARLOTTESVILLE — The man accused of abducting and killing University of Virginia sophomore Hannah Graham last fall will now face a charge of capital murder in the case, meaning that if he is convicted he could face the death penalty.

Jesse L. Matthew Jr., 33, had been charged with first-degree murder in Graham’s slaying, and the charges were upgraded at a court hearing in this college town on Tuesday. Homicides in Virginia can be charged as capital murders when there are allegations of aggravating factors, including abduction or sexual assault.

Graham, 18, of Fairfax County, Va., went missing in September from an outdoor mall near the U-Va. campus, and Matthew was the last person seen with her. Her body was found in a wooded area about 10 miles from campus weeks later, and Matthew was charged with her killing. ... Authorities have alleged that Matthew abducted Graham “with intent to defile,” indicating that police believe he intended to sexually assault Graham.

Matthew also is facing charges related to a sexual assault from nearly a decade ago. He is awaiting trial on charges that he attacked and attempted to kill a woman in Fairfax City in 2005; authorities have said that they found Matthew’s DNA under one of the victim’s fingernails.
