Florida couple convicted of beach sex face 15-year prison terms

ORLANDO, Fla. (Reuters) - A Florida man and woman convicted of having sex on a public beach in the presence of a child are facing up to 15 years in prison and having to register as sex offenders, their lawyer said on Tuesday.
Elissa Alvarez, 20, and Jose Caballero, 40, were arrested on Bradenton Beach in western Florida in July after other beachgoers, among them the mother of a 4-year-old who saw the activity, called police to complain.
A video taken by one of the witnesses, which shows Alvarez, a dental office assistant, moving suggestively atop Caballero, a personal trainer, was posted on YouTube and was widely viewed online.
"They're devastated, absolutely devastated," said Ronald Kurpiers, the pair's attorney. "I don't think that what they did was meant for them to be called a sex offender.

These 2 people were not bothering anybody but of course, somebody was offended and now it's quite possible these 2 are in for some heavy time.
While the Bush mob plays golf.

(20,185 posts)1. He did 8 years for cocaine trafficking. That's why he could get up to 15 years.
2. They were offered a deal - 2.5 years for him, 90 days in jail for her. They turned it down.
3. It was in broad daylight. I've had sex on the beach, at night. I don't recommend it. Sand gets in places where sand shouldn't go.

(2,983 posts)This is a couple that.... had sex... on a beach. A sentence of 2.5 years, or even ninety days, is frigging absurd. A slap on the wrist, maybe a night in prison with a stern "Don't do it again, idiots!" would seem to me to be more than enough.
I haven't had sex on the beach - but I'd have to conclude that, based on what I've heard about it, it would be a pretty stupid idea.
Any reasonable person on planet earth would, I hope, consider a fifteen year sentence to be well beyond frigging insane for the offenses in this case. I would have turned down 90 days in jail for sex on the beach, too - not saying I would have done it - and I certainly would not have in front of children... but, uh, all this prison time, for something kids see on the internet every day? Now they're apparently going to be registered sex offenders in addition to all this other crap.
This goes way the hell beyond nanny state or knee jerk reaction. I mean, seriously... WTF? Is this somehow a very heinous crime because a four year old kid saw it? I mean, the fact that it was even a felony to begin with is kind of ridiculous. OH NOES! Little Jonny saw a thing go into this other thing and two people were naked and doing... OMG OMG, oh the humanity! Won't somebody think about the children!?
Fifteen years. Damn. I wonder if, at some point, the brilliant state of Florida will actually manage to make sex itself a crime, maybe someone will get 90 days for that. They should outlaw masturbation, too, because, well, children, and Jesus. Let's not forget Jesus.

Was the man still on parole or probation? That may have made a difference.
90 days in jail for her again is too much (assuming she has no priors). 7 days and a fine and/or community service (or some combination thereof).
