(1,428 posts)The court has previously ordered her to issue the marriage licenses, she has refused. Since she is an elected official she cannot be fired by the city council but the judge can throw her in jail for "contempt of court."

(67,107 posts)wrist. ... this case opens up so much, for example, it sets precedence for clerks to decide how to interpret the law and to control the process/approval for so much. And, it gives SCOTUS the finger. This needs to be stopped asap, because history is repeating. As some have said, she is the George Wallace of this century. If this is allowed to slide along, it is setting so much precedence.

(3,283 posts)Donations will pay, not her. She will not suffer monetarily regardless of the fines. She will not be able to have a surrogate sit in jail for her. She would be a martyr only to people who already see her as a martyr. Send her to jail if the law allows for it.
Fines will be taken care of with a GoFundMe account. She'll end up making money and not suffer any real consequences. She should have resigned if she had any real convictions about her beliefs.
All the hand-wringing about how jailing this idiot would only serve as ammunition for her cause is nonsense.
Put her behind bars and let the cameras roll. She's denying people their rights, and should suffer the consequences.

REPORT: Rowan County Deputy Clerks Would Issue Marriage Licenses, But Theyre Afraid Of Kim Davis
According to Rowan County Attorney Cecil Williams, the deputy clerks in Kim Davis office would issue same-sex marriage licenses, but theyre too afraid of their boss to come forward. Williams made the claim in an interview with the Kentucky Trial Court Review, which has recapped the not yet published story on their Facebook page. An excerpt:
Todd Starnes: Kentucky Clerk Prepared to Go to Jail
It's fair to say that issuing marriage licenses was something of a family business - until the day the Supreme Court legalized gay marriage.
No, it isn't. What is fair to say is that the position of county clerk is an elected position, not a family business. The clerk is there to assist the citizens of Rowan County in their dealings with the county government.

Her job is clerical. Her signature only attests that a form is properly filled out and filed. She is not sanctifying marriages or marrying anyone. She truly is a moron.

(62,444 posts)As far as competence for the purpose of this legal proceeding is concerned, she appears to be fully informed and capable of choice.
Ive weighed the cost and Im prepared to go to jail, I sure am, Mrs. Davis told me in an exclusive interview. This has never been a gay or lesbian issue for me. This is about upholding the word of God.
That indicates she is completely aware of the potential consequences of her chosen course of action, and is fully competent to direct her defense in this proceeding.

That's up to the members of her play club to sort out.
mnhtnbb
(31,384 posts)Precisely. He's urging her play club to advise her to follow the law, because if she doesn't,
she's the one going to hell.
She's getting bad advice not only from attorneys, but apparently from members of her own
church who don't even know their Apostolic Christian church advises members to follow
the law.

(62,444 posts)First, I'm quite sure that no rabbi is an authoritative source on "what her group believes" any more so than I would expect a Catholic priest to sort out who is a faithful Muslim.
Secondly, it is clear that the rabbi doesn't have much exposure to how these people deal with that particular passage. You can rest assured they feel no obligation to obey a government which requires them to do something contrary to any of their other beliefs.
Her group turned up to support her today outside of the courthouse, so it's a safe bet they don't agree with some outsider's opinion of what they are "supposed" to believe or do.

17. Governmental authority is respected and obeyed. Members serve in a non-combatant status in the military. Oaths are not taken, but truth is affirmed.
jberryhill
(62,444 posts)Then "governmental authority" which is contrary to whatever they think God is telling them to do, is not legitimate governmental authority.
These people are nutcases. It really doesn't mean much that someone outside of their belief system doesn't think they are correctly following the dictates of their psychopathy.
